Abstract/Summary:
This thesis aims to find the best way to reconstruct the enterprisecredit system through careful studies on the status quo of the enterprisecredit and the origin of the current credit crisis in China.This thesis is made of two parts, including the preface and the text.The first part is the preface.The first chapter is the general explanations of the enterprise credit.The first Section discusses credit from three different perspectives,including ethnics, economics and law. The second Section introduces fourcharacteristics of the credit. The third Section is the law meaning ofthe enterprise credit.The second chapter is the significance of the enterprise credit legalsystem construction. The first section is about the status quo of theenterprise credit. It indicates enterprise have suffered from the seriouscredit crisis. The second section discusses the harm of absence of theenterprise credit. The third sectioh is the law analysis on the harm ofabsence of the enterprise credi. The fourth section introduces the meaningand significance of the enterprise credit legal system construction.The third chapter is about legal theory analysis of the enterprise credit legal system construction. The first section indicates theorientation of constructing the enterprise credit system: making ethiccultivation as backbone, self-regulation of enterprises as core, marketdomination as driving force, legal regulations as guarantee andgovernment supervision as support. The second Section is the principleof constructing the enterprise credit system. The third Section discussesthe policy system on the enterprise credit legal system construction:basic guarantee system, regulation system from the whole society andself-regulation system.The fourth chapter is the practical project of the enterprise creditlegal system construction. The first section introduces system of theenterprise credit, involving four parts: The first is self-regulation ofenterprises, including the regulation from inside the enterprises, whichrequires the enterprises to enhance the credit management and improve theability to defend against credit risks, and from the whole industry, whichrequires the guilds to impose efficient supervision on credit. The secondis the credit service system which bears two sub-systems: enterprisecredit information collection system and the enterprise creditevaluation system. The third is government supervision, includingregulating credit markets, helping cultivate credit service markets andsteering social needs on the credit service. But government authoritiesat the mean time should improve its own credit. The fourth is punishmentmechanisms, including market, administrative and legal punishments. Thesecond section is the improvements of the current enterprise creditpromotion systems. The thesis proposes that related credit laws be made.At the same time, we also need to improve the current enterprise creditpromotion systems concerning enterprise access, enterprise managementand enterprise deregistration.
