The EU is an important trading partner of our country. From January to May in 2004, according to the related statistic figures supported by the Bureau of Maritime customs of China, total trades amount between China and the EU is 657.2 USDs . This figures increased 35.9%, which occupied the total amount of 15.5%. It is a trend that the EU willexceed that of Japan and USA and become a biggest trading partner of China .Up to now , Both parties have already got agree on establishing completely strategy colleague in common fields . Therefore more moderate of the economics and trade relationship is its common demand.However , the EU is also the largestest organization in the world to implement anti-dumping against China . Now, the EU adopts 32 cases that end anti-dumping measures used to China 32 rise, there are also 22 which are studying. Since China acceded to the WTO , our country enjoys most-favored-nation treatment on reducing customs duties and other tariffs, which will benefit to improve Chinese export volume on foreign trade. More and more domestic product will enter to the EU market, it will have larger impact on the related industry of the EU.Although the revision law of the market economy position anti China had effected in 1998 , our country was regarded as a transformation economy nation by the EU. The problem of Non-market economics in anti- dumping become a hard nut to crack to our government and the export enterprises. The Chinese business enterprise is still collected the high anti-dumping tax .Particularly on June 28 , 2004 , the European committee in EU declares, owing to the nation get involved as usual and strongly enacted between price and expenses, They can't still admit that China is a " market economy nation". How to help the Chinese export enterprises so that they can get away from the EU regular harassment in market economy as soon as possible is already the most urgency thing . This paper tries to investigates the Non- market economy from its foundation, using the relevant rule in WTO negotiate the book of China , critique EU Non— market economy rule and its change and make some suggestions about how to take effective remedy in respect of EU' s anti-dumping.
