Eu Anti-dumping Non-market Economy Treatment, Injustice And Countermeasures

The Market economy status issue is one of the most important issues of the anti-dumping investigations. In the anti-dumping cases initiated by EU against China , The EU refuse to accept the complete China market economy status. The result is that the Chinese exporting enterprises usually have been subjected to a very high anti-dumping duty as the result of the anti-dumping investigations by the EU. Therefore, the material loss has been inflicted on Chinese enterprises and their employees, which is also disadvantageous for bilateral economic and trade relations. In this thesis, the author makes use of positive analysis to demonstrate unfair treatment of regarding China as non-market economy country systematically and attempt to look for an effective way to solve this problem.First of all, the author analyze several EU anti-dumping cases against China and discuss EU anti-dumping legal system in detail, in particular in that general acceptance but respective recognition toward market economy status.In addition, based on market economy theory and surrogate country theory in anti-dumping investigations, the author specializes several unfair treatment China enterprises sufferred.Last but not least, in terms of anti-dumping against China by EU and China's countermeasures at present, the author puts forward a scheme all together with the government, guilds, enterprises and lawyers, which employing political, economic and legal methods in order to figure out the problem mentioned above.
