| In recent years, there has been endless amount illegal activitiesdamaging Load-bearing walls in shanghai. Without government measuresand effective law enforcement, Violations can not be prevented in time.Unfortunately this will not guarantee the safety of residents and their rights.Therefore an enhancement in law enforcement is needed to prevent furtherdamages on properties.Through the analysis on relevant data of housing law enforcement inrecent years, the implementation effect and social effect of current laws andregulations and the jurisdiction in law enforcement, this article proposes thathousing law enforcement shall, on one hand, protect administrativeprincipals'legitimate rights and recognize their right to possess, use, handleand benefit from their private houses. On the other hand, public interest shall be protected from being violated and the safety of neighboring owners'houses shall be guaranteed. The key element of administrative lawenforcement lies in the balance of interests.The boundary of each right andinterest shall be made clear and the rights and interests shall be distributedreasonably based on that.This article consists of three chapters. Chapter I is titled"Status QuoAnalysis of Housing Administrative Law Enforcement Procedure in China"and it will introduces the status quo of punishment for housing violations inShanghai as well as in China. The emphasis will be laid on housingadministrative law enforcement in Changning district. Chapter II is titled"Relevant Questions in Administrative Law Enforcement". Housing lawenforcement will be analyzed with classic cases. It will also cover thoseoutstanding problems in administrative law enforcement of the punishmentfor damaging housing bearing structure and introduces legal opinions.Chapter III is"Legal Advice on the Problems in Shanghai Housing LawEnforcement". Based on the analysis in previous chapters, this chapter willprovide some initial plans and suggestions. |
