The Analysis Of Some Specific Problems In The Implementation Of The Constition And The Constitutional Review In China

Chapter 1 of this article describes the basic theories of the implementation of the Constitution and the Judicial Review Of Constitutionality in the academic research. For further discussion, it provides the discussion guide.Chapter 2 of this article describes a case happened in the college, through which this article expresses the different opinions against another scholar's point of view concerning the Constitutional Review and the implementation of the Constitution.The article further discusses some specific problems in the parcitce of the Constitutional Review in China. Some scholars call for a breakthrough of the current constitution Supervision by the NPC (Standing Committee). Some scholars hope to establish an independent Constitutional Court. Some scholars argue that the right of Judicial Review should be given to an independent organization.However, the article eventually argues that all these viewpoints are impractical.Chapter 3 of this article discusses the development of the Constitutional Review and the Constitutional Supervision in China.Finally,this article draws a conclusion and the article comes to the end after a suggestion is given.
