The Relationship Of Media And Justice

In today's just and open society of respecting for freedom of speech, pursuiting fair the news media has become a medium of expression of feelings, elaborating public opinions, learning and living information and has a significant impact in the political, economic, social, cultural and people's livelihood. Specially, on the administration of justice, it plays the role of a double-edged sword. Properly utilized, it will be conducive to a just published speech, protecting the rights of victims, monitoring the legitimacy of judicial activities, curbing judicial corruption, promoting the rule of law. On the contrary, mislead the public, against the victim or legitimate rights of the prosecuted, interfer with justice trial. Our judicial system is not perfect. Involving in real life,a phenomenon againsting the rights of the defendants, misleading the public offen happened. News media and the protection of the rights of the defendants are put on the table. How to resolve the conflict between the two, the author made a thorough study and discussion. The first part revolves around why the news media can report the judicial activities and its coverage. In order to solve the coverage of media reporting judicial activities,author discusses the problem from four parts including the citizens of the freedom of speech, rights to information, supervision of judicial activities, promoting the education of law.The second part mainly talk about what citizens'rights are easy to be violated. The conclusion is that three rights of citizens including the rights of fair trial, reputation, privacy are easy to be violated. The third part mainly talk about the experience of the international treaties, common law countries, civil law countries dealing with the conflicts between the two lessons. The fourth part mainly talk about the problem,causes solutions of our contry between the two lessons. How to solve the conflicts is very important.We must improve the internal justice system and limit the media in the external. We expect that the discussion of the four parts above are useful to our judicial practice.
