Improvement Of The Regulations On Government Information Publicity

This paper discusses that the government information publicity, is an important way to realize citizens'right to know as well as an inevitable demand to build a service-oriented government.The Regulations of the People's Republic of China on Government Information Publicity (here in after called Regulations), officially implemented as of May 1,2008, marks that the legal protection system of citizens' right to know in China has been initially established. With the issue of Regulations, the work of government information publicity in China has made a major development. Due to the effect of confidential tradition and defects of information publicity system and the Regulations itself, however, all kinds of problems are encountered during the process of implementation of Regulations, thus creating a gap between the condition of current information publicity and that of what citizens expect. To deal with these problems, clarification of citizens' status of their right to know shall be made at the constitutional level; relevant supporting laws and systems shall be established and completed; the scope of government information publicity shall be extended; the service platform of information publicity shall be developed; the work style of administrative organs shall be changed; government functions shall be shifted; experiences of legal system from advanced countries shall be absorbed; and the relief system shall be improved. This paper presents the concept of government information publicity, the formation of the right to know, the basis for constitutional rule, and the overview of government information publicity system of foreign countries, summarizes the major achievements that government information publicity in China has made, then analyzes the main problems at the theoretical level and at last, proposes several suggestions for further improving Regulations.
