Trade secrete protection is a hot issue amongst the current world economies. This study is based on the traditional jurisprudent of economic law. Methodology mployed in this study include comparative, legislative, economical, and historical. Criterion analysis and demonstrative analysis are also combined to produce in depth analyses of the trade protection mechanism of both United States and China. The similarity and difference of the two countries are compared and studied. United States being the most advance protector of trade secret protection, and together with the long history of implementation of trade secret protection is a very good reference for legislating the future trade secret protection laws in China.This thesis is in four parts. The first part mainly explain the development of trade secrete protection laws in the United States and China. The difference of the two legislative systems and the importance of legal cases in the United States in relation to trade secrete protection. The second part mainly introduce the basic theory of trade secrete protection with emphasis on the understanding, scope, constituent and content of trade secrete protection in the United States and China. The third part starts with the criteria of cognizance as violation of trade secrete protection and continue with the remedies available to victims of trade secrete infringement both in the United States and China. The experience for the legislation and implementation of trade secrete protection laws in the United States is referenced to the future legislation and implementation of trade secretes protection laws in China. The fourth part after compares and analyze the unique features, similarity and difference of the trade secret protection in the United States and China summarizes the study and offer suggestion to the future legislation and implementation of trade secrete protection laws in China.
