| It’s significant to comparative study of the law protection of trade secrets across the TaiwanStraits. Due to the huge differences of the specific legislation and the arguments betweenpractitioners and theoretical circles relate to the protection of trade laws, it’s necessary to analyzethe question in following aspects.First of all, it’s still necessary to further clarify the constituent elements, the characteristics, theextent and the identification of trade secrets in the basic category.Secondly, this paper mainly focus on the identify standard of violation of trade secrets, and putforward a more viable standard of infringement based on the comparative study of the samples.Additionally, due to the non-legislation of business strife, it’s difficult to identify the legality of it.This paper shows the comparative study of the legal limits and the effective factors of businessstrife.Above all, the author gave some advices of legal and civil ways based on the comparation ofcivil, criminal and administrative differences of the trade secret relief system between Taiwan andmainland.The author holds the opinion that it’s still has some problems in the standard of legalidentification of infringement, and the clause of business strife need to be further clarified. |
