The science and technology of America is the best in the world. And it makes all aspects of the society develop very quickly. In the development of the science and technology, vocational education makes a very important role. The higher vocational education contributes itself to the higher education of America in a popular style. Institutionalizing of vocational education is an important way for efficient management, it also ensure the development of the vocational education. The vocational education law makes a direction role for the development of the vocational education of America. The higher vocational education deeply benefited from the law of the higher vocational education. To put vocational education into the orbit of institutionalizing in all forms of the legislation, and to force, develop, consolidate the implement of the higher vocational education is a big experience of America.The higher vocational education legal system of America comes through four phases. The contents of the act in each phase all aim at the needs of the social economic and states' development, all promote the development of the higher vocational education. As the first higher vocational education act in the education history of America, the Morril Act begins the history of imbursing the vocational education by federation government; Smith-Hughes Act signs the system of vocational education come into being; Veteran Job Act begins higher vocational education's popular step; in 1960s Vocational Education Act and its amendments ensure the high speed of the development of economy; Career Education Act and the career education movement makes the direction of the vocational education's development based on the theory of the life-long education; and Carl D. Perkins Vocational Education Act and its series amendments adapt the challenge of new technology revolution, emphasize the amalgamation of science education and vocational education , open the door of vocational education for all the people, and strengthen the force of federation in the legal system management on vocational education.There are six parts in this paper. The introduction is the first part. In this part the author explains the bases, purposes, meaning, methods, emphases and difficulties of thestudy. In the second part the concept of the higher vocational education and institutionalizing was analyzed. A study on the history of the higher vocational education was held in the third part. The importance of the legislation on America's higher vocational education was concluded. The introspection and prospect of its institutionalizing was the main content in the forth part. And in the last two parts the author gives the suggestion and his own thought in the construction on the higher vocational education and its institutionalizing.The author tries to conclude and pack up the clew and phases of the institutionalizing of America's higher vocational education, and anatomy its characteristics, sum up its experiences in a way which integrate the history and theory. The research mainly adopts the method of documental analysis, the method of history study and the comparative method of study.
