Research On Legislation Of Government Information Publicity

This article is guided by theory of Information Resouces Management(IRM) and Jurisprudence, and its main clue is legislation of government information publicity. The author sets out from government information publicity and its legislation in our country, draws some successful experience from abroad, and goes on making a complete and systematical study on some basic theories of legislation of government information publicity, including some specific steps, such as feasibility, necessity, level, model, system and structure of legislation. A legal framework for the comparatively complete government information publicity is constructed from the above-mentioned aspects.Starting from the status quo of government information publicity and its legislation in domestic, the article makes an analysis of the obstructions which the government information legislation have to face up with, inquires into the necessity of government information legislation from the angles: political, system, law, economy and national security, and discusses the feasibility of legislation from the aspects of legislative bases and realization conditions.After that the article introduces the legislation practice in the countries of North Europe, Continental law system, Anglo-American law system and so on, draws some successful experience from foreigncountries, and summarizes the basic contents of their legislation and the general trends of legislative development for reference.Finally, the article focuses on the legislation structure. It holds to make regulation of government information publicity before making government information publicity law, to adopt the centralized special legislation model, to emphasize five kinds of systems, and to discuss the basic framework of legislation from seven aspects: subject, content, way, procedure, charge, relief, supervising and ensure of government information publicity.
