Preliminary Study On Government Information Publicity Exempt Legislation

Government information publicity is a very important part in this information stage of the social democracy and monocracy.The core of government information publicity study is the content and its scale.Within this core,public exempt which is the exception is the difficult point in the study. For we can only get the content and scale of the exempted publicized information then can we get the content and scale of the open information.So the legislation on exempt information of government is the crucial important part of the legislation.This paper mainly discusses the lawfulness of exempt information from government.And then its theoretical foundation and accomplishment of the law system.This paper can be divided into three parts: theory,practice and further expectation.In theory part,the author discussed the Jurisprudence foundation of government information publicity.The author first defined government information publicity and government information exempt.Then further discussed the lawful theoretical foundation of this public information exempt which is the restrictions on Right of knowing the inside information as well as the scale of the liberty of speech.In practice part,the author cites examples from American,United Kingdom,Korea and Netherlands,and then sum-up the insight on Chinese legislature.Then he focuses on the present situation of china's legislature. Upon the analysis of Chinese legislature function and come up with the short comings of our government information publicity exempt.In this part,the author will come up with a proposal on perfecting the Chinese government information publicity based on the previous expressed theory and present status analysis.The proposal will be submitted from theory, lay system and regulations.Theoretically the author holds the opinion that exempt legislature should also follow the fundamentals of jurisprudence to finalize the legislature principal on exempt information.In law system,special legislation should be improved and perfect the related legislation.And lastly on regulations the government should gradually perfect the relief regulations.
