View On The Institutional Foundation Of Harmonious Doctor-Patient Relationship

As all we know, the doctor-patient relationship is one of the focus issue that been hotly talked about. So there are so many researches on this topic. Generally speaking, they achieved in the two fields. One is about the medical ethics of medical staff. It says that the medical workers'values alienation lead to the intense relationship. That is why the good medical ethics of medical staff is the key to set up a harmony doctor-patient relation. The second reason of this nervous relationship is the absent of the government. The other important aspect to build a harmony relationship is to intense the government'responsibility.According to my search, there are not so many articles talked bout the doctor-patient relationship on the view of the right and duty. In order to deeply find out the reason of the intense relationship, this paper will continue the forfather'task; add a method of right and duty analysis. And take consider of our practical, to analysis the institutional reasons of this bad relationship, so as to find out the practical way for a kind relationship. There are three main parts in this paper. Details as follow.First, the ethic base of doctor-patient relationship. The key point in this relationship is the right and duty between the two parties. So to detail the right and duty of doctors and patients is the primary part. According to this, the doctor-patient relationship could be divided into three kinds. There are initiative-passive, guidance-cooperation and co-work. The value of kind doctor-patient relationship is justice. It needs a fair medical institution which looks forward the benefit balance of the social, the government, the medical staff and patient.Second, to analysis the institutional reason of the nervous relationship in present China. On the view of the right and duty between the two parties, the main two aspects should be point out. The first reason is under the market economic, the medical revolutions always paid attention to its economic efficiency rather than justice. The second reason is the government took on responsibility of its own. The basic medical service and recourses are not enough, meanwhile, the distribution are not equal. The medical staff and the patient'right could not be protected. People'basic medical need and the medical workers'basic living right been ignored. Taking less consider of the two sides could not got the same medical information, so a lot of unequal distributions during some medical cases. The third reason is that those institutional revolutions lead to the both parties ethic alienation. bad management were promoted by interests. Some medical workers even pursuit the largest economic merit on the patients. On the other hand, over-defend cases happened occasionally.Third, the institutional basic to set up a harmony doctor-patient relationship, take consider of our practical condition, the way to build a kind relationship include the follow aspects. 1, to set up the economic foundation, to enhance the responsibility of the government, to rearrange the medical resources equally, to improve the medical insurance system. 2, to set up the ethics foundation, to improve the management in hospitals, to do more medical ethics training of the medical staff, and to put forward the ethics training in common people. 3, to set up the legal foundation of king relationship. Enact a new law"medical service law"to arrange the right and duty of the two parities. So as to protect the both sides'rights. Meanwhile, the medical lawsuit system should be consummated according to justice.
