With the gradual development of reform of medical industry marketization, a lot of problems in the medical industry were exposed. In recent years, although a reform of China's medical service market has been developing, but the level of health care still should be improved.In order to safeguard the rights and interests of the people's health and raise the level of the health care market, we must improve the effectiveness of health supervision and enforcement.Health supervision and enforcement is a very important form of national health management of which basic task is guarantee the order of medical market, prevent and control the occurrence and spread of disease and protect the health rights of people's. As the same to other administrative supervision,china's health supervision experienced the period of general supervision and legalization of the supervision, it is accompanied by the promulgation and implementation of the health laws and regulations. The relationship of supervision institutions and supervised organizations, the providers of medical service and patients is different from the relationship of trade companies and customers. It rely on the regulations and law of medical institution supervision and management to ensure the order of medical service market, decrease and control the medical malpractice to achieve the goal of protecting the people's health.This thesis, by the guidance of the theory of health supervision, takes the non-profit medical institutions, prevention and health care institutions, for-profit medical institutions as the target, takes the data of attack illegal medical practice in 2007 and 2008 as the consent, by using the method of looking up documents, the interview method and the case analysis method, by using EXCEL2003 to analysis the illegal medical practice and administrative punishment, we master the present situation of ownership structure of medical institutions and illegal medical practice in Jilin city and find out the problems, the restrictive factors and proposed the solutions.This study will development from these parts as follow:Part 1. The present situation of medical institution supervision and management in foreign countries.In this chapter, we introduce the present situation of supervision and management in Canada, Britain, America and Germany, our country and Jilin City.Part 2.The theory of medical institution supervisionWe expound the concept, the main content and connotation of medical institution supervision, the concept and nature of medical market, the concept and category of illegal medical practice, and all above is the theoretical basis of this thesis.Part 3. Survey and AnalysisThrough attacking the illegal medial practice, we get the information of present situation of medical institutions and illegal medical practice in Jilin City, and raise the rectification measures, management countermeasures, Standardize the medical services market and strengthen the administrative management of medical service market. The results showed that: in the process of attacking illegal medical practice in different medical institutions, we found that the phenomenon of employ non-technicians of medical still exist in different degrees, as well as rental and contract the department, licensed over the allowed ranged and so on. The illegal activities in the medical supervision is licensed over the allowed range, employ non-technicians and disinfection, collection of medical waste is not accord with requirement. Through analysis we got the reason of the illegal medical practice: Impelled by advantage of commerce, some problems of management, lack of propaganda and legal loophole. Part 4. problems of the supervision in medical supervision institutionBecause of short time development, the medical supervision in Jilin City still exist some problems:1. Inadequate supervision of medical and health system(1)the law enforcement agency does not unify(2)the enforcement is confused(3)medical and health supervision network system of twins and villages is not in place(4)Law enforcement status of health supervisor is not clear(5)The combining of related department is not in coordination.2. Solution countermeasureIt is not difficult to see that the degree of legalization and rationalize in china is not high, and there is presently the ubiquity of the phenomenon of illegal medical practice. The reform of health supervision mechanism is a major issue, and it is never the simple division of the agency. We should put reform of the medical supervision mechanism in the big environment of transformation of government function, unified the leadership, comprehensive treatment, clear layer, function clearly and coordinated operation. On the basis of obtaining the present data, this thesis found out the key dubiety according the present situation investigation, raise the countermeasures and analysis the deficiency in daily medical supervision, and then the countermeasures are as follows:1.Strengthen health legislation2. For a long time, the medical supervision has been undertaken by epidemic prevention station. The disadvantage is subject of law enforcement and enforcing law group were separated, medical supervision and paid service were not separated, and took enforcement of public health more important than medical affairs and women and children. The illegal medicine practice directly endanger people's physical and mental health, so we must go on working hard and with the power of the media to strengthen the striking power to illegal medical practice. At the same time, we hope the laws and regulations can be perfect, maintain the order of medical market and protect the people's health. This thesis, by survey and analysis the present situation of medical institutions, special attacking and illegal case, we have found out the origin and put forward the measures to improving the enforcement power, reduced the illegal medical practice, improved the quality of medical service and changed the present situation of medical supervision. |
