| On Dec 26th,1989,Law of Urban Planning for P.R.C was permitted and published,which declared the importance and significance of urban planning in national life and defined the object and scope of urban planning,but this law only entitled administration of urban planning to carry out urban planning management,as to how to implement planning management,we still haven't got a specific answer. This thesis is to figure out the legal construction way of planning management fitting into local characteristics and its economic management in terms of the characteristics of urban planning,developmental process of planning laws and government's functions in our country which is characterized with wide area and obvious regional differences,Commencing with Shenyang urban planning management which is familiar to the writer,the thesis explored the emergence and causes of local regulations and its implementations in different periods in the process of conversion from planned economy to market economy,specifically elaborated the developmental process of Shenyang planning management laws and regulations and discussed the impact of national regulations on the establishment of local regulations and planning management,from which we can see the local government's efforts on urban construction,legal construction of urban planning management and the process on how local regulations approached to national regulations.Taking minimum distance for sunlight of residential buildings and lighting standard as a beginning point which is the usual one in planning examining and approval management and is also one slice of Codes of Urban Planning for Urban Residential Area(GB50180-93)closely related to urban residents' life,the thesis analyzed the typical case in daily management and explored the problems resulting from lighting standard for residential buildings applied in actual planning management.At the same time, through probing into the differences of minimum distance for sunlight management between local regulations and national regulations in several typical big cities,the thesis explored the approval degree of regulations in local area and its seriousness as a compulsory item.At last,the thesis analyzed the reasons for its poor correspondence between local regulations and national regulations in many aspects,such as urban government's responsibility on urban development,urban economic development requirements and recent change of land value & the development of real estate economy.And it also explored the regulation systems corresponding with planning management of our country,which make planning management on the way of law-oriented,instruction-oriented and management-oriented fitting into our national conditions. |
