Since three decades of reform and opening, china's economic development has made remarkable achievements, but the environmental problems we faced are also increasingly serious. Under the guidance of sustainable development and the scientific development concept, our country make the economic growing and environment more and more harmonious, in 2006 the government write the environmental protection goals of the main pollutant discharge 10% reduction down in the countries of the eleventh five years'development plans. Environmental problems, especially the pollution prevention attack the attention of state and public. Meanwhile, enterprises as important force of the economic and social development, for their acts of production and operation, enterprises also become the main body of pollutant emissions. How to conduct Discharge behavior of the enterprises effectively will be the key of reduction in pollutant emissions and to prevent further deterioration of the environment.The first chapter discusses the important meaning of regulating the enterprise pollution discharge behavior through the legal regime construction, the research background significance, the research mentality and the domestic and foreign research present situation.The second chapter analyses on why to perfect the existing conducting system. And this chapter also introduces the existing systems which conduct discharge behavior of the enterprises in the levels of constitution, basic law and Separate regulations.The third chapter studies deeply on the existing conducting systems, such as three simultaneous systems, discharge reporting system, the emission fee system, environmental impact assessment system, deadline governance, total control system and environmental incident reporting and handling system.The fourth chapter introduces overseas legislation of the present systems, especially the situations in the United States, Japan and France. This chapter also summarizes their advanced legislation experience and the exploration of advanced systems.The fifth chapter puts forward the suggestions to improve the existing conducting system.
