Research On Legal System Of The Wetland Protection In China

The wetland, which is called as "the kidney of the globe", is an important ecological resource, and is as the same as the woods and seas as the three-biggest eco-systems. Wetland has important ecological, social and economical value, and it is deeply related to the survival and development of human beings. China is rich in wetland resources, but with the development of the economy and society, the ecological situation of wetlands is seriously deteriorated, wetland is facing a crisis which is degeneration, and is even losing its function.At present, China has preliminarily established a legal system to protect the wetland. However, the legal system has many problems, the biggest problem is the lack of the specialized wetland protection law. In order to deal with the increasing serious degeneration phenomenon of wetland, and carry on integrity, systematic, comprehensive protection and rational development and utilization to wetland ecology system, we need to establish special wetland protection law urgently, so as to improve the wetland protection legal system in China.This article starts from the legal status of wetland protection in China, with historical analysis, comparative analysis, systemic analysis and other methods to analyze the problems and the reasons in China's wetland protection work, based on some related experience of wetland legal protection law in some foreign countries, using for reference, the writer gave some suggestions to improve the wetland protection system. This article can be divided five parts:The first part is an introduction, it mainly introduced the article's research backgrounds, significance and methods. The second part is an overview of the wetland and its legal system theory. The third part described the wetland protection status in China and its problems. The forth part briefly introduced the experience and conclusion on how to protect wetland in some foreign countries. The fifth part gave some suggestions of improving the legal system of wetland in China, in order to provide effective legislative proposals to resolve the problems in wetland protection work in China, and to offer theoretical reference to China's wetland protection and reasonable development and utilization.
