On The Legislation Value Of Environmental Protection

After the serious environmental pollution and destruction problem appeared in fifty or sixty times of the 20 century, more and more people ware about to the environmental problem. A lot of serious environmental problems have got the administration to the importance of the severity of the environmental problems. With the years of development, environmental protection has already got the common understanding.This paper starts with the legitimacy of environmental protection. The justice theory begins from the individual demand. Interest origins are from the dissatisfied demand. Each person has different interests. However, interest objects are useful for each person. Each person can use these interest objects to seek respective interests. Law of justice is the solution to interest conflict.Environmental protection is a complicated work which involve more social cooperation, more science and technology support and so on. Now, we noticed that sustainable development idea is the basis of law and science. We must adjust the relationship between man and nature. And we also must recognize the human is ordinary members of nature. We must accept the law of nature. Facing with the constantly aggravating global environmental problem, the subject for us to study is how to develop the environment law's modification, and perfection. At the same time, compare and reference other countries successful experience is also an important task.In this paper, the situation and problems of our environmental protection legislation will be described and clarified. Also I will give my point of view of it. I would like to take the opportunity to make people more deepen awareness of ecological environment, and also improve the legal system construction of environmental protection. The theme will be discussed through four parts. The first part introduces the basic theories of Environmental protection, including the origin of Environmental protection validity, jurisprudence basis and limits. The second part shows research conditions of legislation value in several foreign countries and revelations for us. The third part points out the legislation value deficiencies of our environmental protection on legislation guiding ideologies and systems, such as old conceptions etc. The last part gives the choices of legislation value of environmental protection in our country. And following this, improve our fundamentals and systems of our environmental protection legislation value.
