| Due to the industrialization and modernization, the world is undergoing a quick change with each passing day. Meanwhile, the improvement of living quality in China brings environmental pollution and ecological damage. It’s in the environmental crisis time when environmental right comes into being, which reveals an appeal of people for a healthy and graceful environment of living and production. Since the environment right is brought up in 1960s~1970s, it has caused great concerns among experts, scholars and the society’s public, providing a breakthrough for solving the environmental problems, thus guarantees the environmental right of the public as the hot topic through legislation of environmental right.Researches theories of environmental right in China can be dated back to 1980 s, sharing an abundance of theoretical achievements of environmental right. Though there was a rising call for legislation of environmental right in 2014 when the environmental protection law was in its revision stage, the legislation of environmental right was not realized, showing the insufficiency and immaturity of environmental right theories in China.This dissertation makes a research on legislation of environmental rihgt with the methods of literature analysis, system analysis and the method of theory with practice.This research begins with basic concepts about legislation of environmental right, analyzing legislation of environmental right. After an analysis of the significant functions and fundamental theoretical of legislation of environmental right, this research has a discussion about status quos and insufficiency of legislation of environmental right in China. Analyzing and reflecting legislation of environmental right abroad, this research attempts to make some suggestions to improve legislation of environmental right in China.The thesis is divided into five parts to the environmental right. The first part is the introduction article,mainly on research background,purpose and significance,research situation at home and abroad,and research ideas,methods and innovation points of the system is introduced,in order to make clear environmental right research background; Second part for the basic theory of environmental right, including the notion of environmental right,the function of the legislation of environmental right,the princples of the legislation of environmental right,etc,for the legislation of environmental right to provide theoretical support; The third part is the situation and the insufficiency for the legislation of environment right, from legislation of national environmental right’s present situation and the legislation of local environment right’s present situation analysis, pointing out the problems that the legislation of environmental right in China, the legislation system of environmental right, the legislation model of environmental right, the principle of environmental legislation and the legislation of environmental right’s procedure; The fourth part is about the overseas legislation of environment right’s practice and enlightenment, from several typical countries legislation of environment right’s practice, analyzing in detail the current situation for legislation of environment rights in Japan, the United States, Switzerland and other countries, and pointing out meanings that the national environmental right’s legislative practice for legislation of environment rights in China; Fifth part is the Suggestions of perfecting the legislation of environmental right in China, in this section,pointing out the means for perfecting the legislation of environment right, namely, improvement the content of the legislation of environmental right, improve the legislation system of environment right, perfect the legislation mode of environment right, perfect the legislation principles of environment right and perfect the legislation procedure of environment right. |
