The Research On Prevention Legal Countermeasure Of Basin Water Pollution In China

Water is not only the source of human life, but also the foundation of our society whose survival and development lies on water. All of the formation, flow and transform of water resources take river basin which provides us with the most important water resources. as a unit, the river basin How to deal with the relationship between economic development and prevention of river basin pollution is the common difficult problem which is ahead of the world .Especially in China, the average amount of water resources per capita is low, and the distribution of water resources is extremely uneven .The treatment of river basin pollution of China faces the more difficult test. After 20 years of the river basin pollution treatment, river basin pollution is further serious, and the river basin pollution accidents are happening frequently. Besides the fast growth of the economy, there exist many other defects in the legal system of river basin pollution control are the reasons.Firstly, the legislation of prevention and control of river basin pollution is imperfect. Secondly, the system of prevention and control of river basin pollution is unreasonable. Thirdly, market mechanism hasn't been used widely. Our country should learn from foreign and native experiences of the water pollution prevention in some famous water basins ,and base on the drainage characteristics of river basin , and then improve mechanism of comprehensive prevention and control of river basin pollution and legal system. First, we should improve legal system of prevention and control of river basin pollution, laws and regulations of river basin administration,legal guarantee system of environment-economic policies which are related to prevention and control of river basin pollution, coordinate relationships of laws and regulations which are related to environmental and water administration. Second, we should reconstruct the administration mechanism of prevention and control of river basin pollution from the perspective of river basin and region. Third, establishing and improving plan-warning mechanism, water-saving and discharge-cutting system, discharge permitting system, the system for controlling the total quantity of pollutants, economic compensation system for Tran-region pollution and system of handling disputes, public participation system, legal liability system, system of comprehensive prevention and control of area pollution, investment and financing system for prevention and control of water pollution, etc.
