Legal Research Of Snow-Ice Resources Management

Ice-snow resource which is a kind of seasonal natural resource is changing with each passing day as economics and civilization of the modern society. In recent years, ice-snow resource has been gradually and broadly added a layer of the extension of social resource. The government has completed certain economic and cultural effects by way of intensifying the ice-snow industries as well as promoting and enriching ice-snow culture. There are some problems in the course of the developing and utilizing ice-snow resource, such as the inconsiderate management of the government; single market structure; under-developed operation principle; the public low enthusiasm of participation and etc. However, ten southern provinces'poor preparation of the disaster which had come unexpectedly in 2008 made serious loss of property that alarmed us. We recognized that ice-snow resource is not merely for developing and utilizing of ice-snow industries, and snow disaster prevention has not only belonged to the north, but also for the whole nation. It must be taken charge of by the whole country.So, our government must pay more attention to the management of ice-snow resource. Firstly, this article deeply analysis the history of ice-snow resource development through defining the concept of the ice-snow resource management and acknowledging the characteristics of the ice-snow resource management, and then lay a solid theoretical foundation for presenting correct legal plans and suggestions. Secondly, the article presents three aspects of questions which are concluded by comparing the recent condition of the ice-snow resource management between home and abroad. First aspect, in security legislation, the questions are lack of government management, low level of existing laws and regulations and the deficiency of uniform management of disaster prevention and reduction. Second aspect, in organization, the problems are low efficiency of the subject of law enforcement and lack of collaborative consciousness which is caused by devoid communication among the government organizations. Third aspect, market conduct, public information, public participation and financial investment all have some questions and insufficiency. We should study hard from the excellent experience and methods of foreign ice-snow resource management. On the basic of sustainable development and aiming at actuality, the government should legislate new principles to confirm the development of the ice-snow industries, perfect current laws and accelerate the formulation of "Basic Disaster Prevention and Reduction". The government also should perfect the ice-snow disaster response mechanism which include pre-alert before disasters, emergent action during the disasters and rebuilding after disasters. At the same time, public participation, administrative accountability and financial input system should be intensified to make sure that the ice-snow resource management goes well and finally achieve a win-win between economic social effects.
