Research On Government Regulation Of Algorithmic Power

At present,there are countless social security problems caused by takeout riders racing against time and desperately on their way.The reason is that in order to pursue distribution efficiency and maximize profits,platform operators try to design and manage riders through algorithms to reduce the time from merchants to customers as much as possible.The algorithm rules of the platform have actually become the tools and means to manipulate the behavior of takeout riders.As the core technology of artificial intelligence,algorithm has attracted great attention from all walks of life for its instrumental functions such as autonomous learning,assisting decision-making and allocating social resources.Since Scott Rush put forward the view that "power exists in the algorithm",the research on algorithm embedding power operation system,algorithm dominating social action,algorithm power regulation and so on has aroused the concern of scholars at home and abroad.At present,"algorithm power" has become an important topic in social science research.However,all people with power are prone to abuse power,and algorithmic power is no exception.The coupling and interaction among the factors such as the greed for power in human nature,the concealment and expansion of algorithm power,and the imperfect constraint mechanism are the root causes of the abuse of algorithm power.The performance of the abuse of algorithm power is mainly reflected in the domination and manipulation of the power object by the power subject of the algorithm.Based on the analysis of the above problems,it is considered that the operation of algorithm power will bring great uncertainties to social operation and government governance.in order to achieve the goal of modernization of national governance,there is an urgent need for the government to regulate algorithm power.Algorithm power is a kind of social power,which is a kind of domination over the state and society formed by certain social subjects by virtue of their control over the resources of the algorithm system.From the perspective of human nature,the subject of power is morally questionable,while ethics can be internalized into the moral value and conceptual power of the subject of power,which intrinsically urges the subject of power to consciously control bad desires and exercise power healthily;the formulation of a rigid system is based on the consideration of the worst consequences of power,trying to avoid the risk of abuse of power by establishing a serious institutional system.Algorithm technology is the basis of the generation of algorithm power,which means that the regulation of algorithm power must proceed from algorithm technology and restrict the risk of abuse of algorithm power by the optimization and perfection of algorithm technology.Therefore,by using the method of normative analysis,on the basis of systematically discussing the connotation of algorithm power and analyzing the risk of algorithm power abuse,this paper constructs a three-dimensional framework of government regulation algorithm power from the perspective of ethics,system and technology.Around the core issue of the research,this paper draws the following conclusions:first,the algorithm power can be proved from the point of view of dominance.Second,the algorithm power is easy to be abused by the power subject in the process of exercise,which mainly includes the abuse of human factors such as the desire for power,the influence of the self-alienation tendency of algorithm power and the restriction of algorithm power restriction mechanism.Third,once the algorithm power is abused,it will easily lead to a series of risks.in the field of government governance,the abuse of algorithm power will lead to risks such as public power overriding civil rights,capital power dominating public power,algorithm black box diminishing government trust and so on.In the field of social governance,the abuse of algorithm power can easily lead to social negative effects,such as the intensification of social stratum differentiation,the intensification of social interest contradictions,the prominent problems of data security and so on.Fourth,it is necessary for the government to explore the reasonable approach to the power of regulation algorithm from the ethical dimension.First of all,from the level of fairness,the subject of algorithm power should practice fair value in the practice of algorithm,put an end to intentional discrimination and avoid unintentional discrimination;secondly,it should require the subject of algorithm power to abide by responsibility ethics from the level of responsibility;finally,it is necessary to require the subject of algorithm power to realize ethical legitimacy from the level of legitimacy.Fifth,the government can regulate the algorithm power through system design.First of all,we need to clarify the regulatory subjects,including government regulatory departments,algorithmic platforms,third-party forces and the public,and then we need to improve the algorithmic power supervision system,including the establishment of hierarchical supervision system,classified supervision system and process supervision system.Finally,we need to improve the implementation mechanism of the regulation system,including the construction of responsibility and obligation system,the construction of supervision policy system,the strengthening of talent team construction and so on.Sixth,as a kind of technical social power,the government should regulate it from a technical point of view.First of all,we need to clarify the boundaries of data acquisition and establish data processing standards;secondly,we need to clarify algorithm structure rules,evaluate data mining technology,and review algorithm alternative variables;finally,we need to develop algorithm transparency requirements from the aspects of algorithm understandability,openness,accountability and so on.In the context of Lawrence Lessig,the regulatory method of cyberspace is composed of law,social norms,market mechanism and procedural framework,which means that the reshaping of algorithmic social order and the regulation of algorithmic power require the cooperation of legislators,administrative organs,technology companies and social citizens.in this sense,the approach of algorithmic power in government regulation is helpful to achieve the development goal of intelligent government governance.
