With the rapid development of Science and technology,the Internet space continues to expand in social life,and various digital platforms also rise.As the core factor to realize the function of platform,algorithm has caused an unprecedented impact on the operating mode and development direction of platform,and platform algorithm has gradually shown the power attribute.Platform algorithm power is based on technology,showing its hidden and expanding side,which will inevitably lead to application risks,so regulating algorithm power has become the proper meaning of governance platform.In view of this,this paper will take the application risk of platform algorithm as the background to analyze the legal regulation of platform algorithm power.First,clarify the concept of platform algorithm power.By expounding the meaning of platform,algorithm and power,the concept of platform algorithm power is foreshadowed.Before further discussing the power implication of platform algorithm,we will emphasize the existence of platform algorithm power.This paper focuses on the substantive impact of platform algorithms on social practice,and with the help of Hofeld’s rights theory and Foucault’s view of power,observes the exercise of algorithm power on social media platforms and online food ordering platforms from the perspective of connection,explores how platform algorithms affect traditional civil legal relations and labor and employment legal relations,and further proves the existence of platform algorithm power.In the process of transforming social practice,platform algorithm power shows the characteristics of technology driving,virtuality,diffusion and concealment.After clarifying the power connotation of platform algorithm,this paper will investigate the power operation mechanism of platform algorithm.Technology is the power source of platform algorithm,big data is the basis of platform algorithm power operation,digital space and user rights transfer is the premise of platform algorithm power operation.Due to the profit-seeking of platform capital,the concealment of algorithm technology and the natural expansion of power,platform algorithms are prone to various risks during operation,such as algorithm discrimination caused by algorithm black box and "information cocoon" caused by personalized recommendation algorithm.At the same time,the value orientation of technical rationality supreme contained behind the platform algorithm will pose a threat to the human subject value.In view of the potential risks of the power of platform algorithms,this paper puts forward several considerations: conceptually,it is necessary to clarify the tool attributes of algorithms,emphasize people-oriented,enhance the transparency and interpretability of algorithms,improve the accountability system of algorithms,reasonably restrict its use scenarios,and strengthen the protection of individual rights.
