Research On The Legal Regulation Of AI Algorithm Power

The concept of artificial intelligence technology has been put forward for more than 50 years,and its rapid development pace has exceeded the original conception of the technology.In the 1920 s of the 21 st century,artificial intelligence has made remarkable breakthroughs in the bottleneck of technology,which has a wide and profound impact on all fields of human society,and brought the understanding of technology to society.If we further explore artificial intelligence technology,it is not difficult to come to the conclusion that the core of AI technology is algorithm model.As a kind of intelligent mechanism to describe the problem solving by systematic method,algorithm is a universal and has not yet perfect the technical norms of law regulation.Under the background of the big Internet in today’s society,algorithms play an increasingly important role.Based on their control of algorithm technology,the application gradually derives an algorithm power,which originates from the technology extension of capital and political power,and has a strong social identity of the price basis.That is,power should be limited.If there is no effective law or system to regulate it,once the abuse of power will bring immeasurable harm to all the subjects of society.At present,there is no legal norm for the regulation of algorithm power in China,and there is no good solution to the problem of abuse of algorithm power.The personal information protection law(Draft)issued in 2020 puts forward the measures to increase the obligations and responsibilities of algorithm platform,and set up supervision framework and audit system,but there are still difficulties in the specific implementation and operation,It is urgent to improve and solve it.According to the characteristics of the algorithm and the local conditions of our country,and referring to the scheme and experience of the regulation outside the country,the author combines the individual empowerment,supervision audit and the construction of the algorithm accountability mechanism,and improves the litigation security system,and provides some reference schemes for the power legal regulation of artificial intelligence algorithm in China.
