Cadastral survey system enhancement in the Hong Kong Special Administrative Region of the People's Republic of China (a study of survey law reform in Hong Kong)

Abstract/Summary:
The aim of the research is to seek solutions to enhance the Hong Kong cadastral survey system. Based on a wide spectrum analysis of the strengths and weaknesses of the system, which included an analysis of the current Hong Kong legal settings on cadastral survey, a study on the land boundary and title dispute court cases, a review of other leading cadastral survey systems and their survey law in particular, a study on the local boundary dispute cases at the professional practice level, a historic review on the development of the system, and a report on the current institutional arrangement including the government and private sectors, this research concludes that defects are rooted from the lack of boundary security consideration in the law.; Based on the findings of the above analysis, a questionnaire addressed to the members of the Land Survey Division, the Hong Kong Institute of Surveyors, on the various items of improvements to the Hong Kong land boundary survey has been conducted. The majority of the replies pointed out that having a better survey law is the solution to the boundary problems.; Two scenarios of the land boundary system development were analysed and proposed. The first one works with the systmatic re-survey of the New Territories and the other works with legal amendments to the existing Land Survey Ordinance for which is a change of concept in the survey law. As a result of this study, the development paths of the Hong Kong land boundary surveying service are identified.
