Intellectual property(IP)has become a strategic element in enhancing the competitiveness of a nation,a region,and an enterprise,of which patent is the core part.High-quality patent service is the basis for acquisition,exploitation,protection,and management of patents,and thus must be emphasized with high attention.In order to promote the innovation and development of local patent services,the state and local governments have formulated a number of administrative provisions or special policies in the fields of science and technology,IP,and patent.However,these policies are immethodical,overlapped,or even contradictory among themselves,with the rationality and effectiveness of many policies having yet to be verified.Such deficiencies can greatly impact the function of the policies and even hamper innovation.Therefore,there is an imperative need for a systematic study on the public policy for patent services with the combination of practice and theory.This paper takes the Guangdong Province as an entry point with the background of the nation and typical province and cities,aiming at extracting the essence of a theoretical system for the public policy for patent service by going from theory to practice and then back to theory.First of all,the basic theories of the public policy for patent service will be illustrated.The concepts of patent service and public policy for patent service will be defined.Based on the analysis of the contents,subjects,and nature of patent services,the patent services are defined as customized and professional patent services provided by commercial organizations,including specific services such as patent agency,consultation,information,business,law,and training services.Considering the characteristics of the public policy for patent service is defined as a process in which governmental or special organizations provide guidance and regulations for in the aspects of environment,market,human resources,information,management,and supporting measures through appropriate system configuration and policy design.Based on the guiding,coordinating,distributing,restraining,and developing functions of public policy for patent service,the author establishes the system model for operating the public policy for patent service,clarifies the subject,object,and constituent elements of public policy for patent service,including environment,market,motivation,talent and information And constructs a perfect public policy system of patent service,which provides the theoretical foundation for promoting the development of public policy for patent service.Secondly,a further analysis on the public policy for patent service of Guangdong province is performed.Through evaluating the public policy for patent service of Guangdong province by questionnaire and SWOT analysis,it was found that the government,the intermediary service agencies,and the enterprises in general were satisfactory with the public policy,though still thought there are many problems.The advantages of the Guangdong Province were not prominent,while the disadvantages thereof were relatively obvious.There were many development opportunities,yet coexisting with threats.Particularly,the problems of the public policy for patent services of Guangdong lay in the irrational goals and deficient contents of the policy,the insufficient coordination and overlapped management among different departments,lack of fair and effective policy implementation,lack of effective and feasible policy for market demand,and imperfect development planning and inadequate financial input of human resources.The opportunities were the innovation demand brought by economic globalization,new technology development,and government innovation management.The challenges were the unfair international trade rules for IP,the disrupted competition environment of the patent service market,the subversion of the patent service concept,and the unsound self-regulatory mechanism of this industry.Thirdly,the public policies for patent service of the nation and typical provinces and cities will be comprehensively summarized.This paper sorts out public policies for patent service introduced in the nation and typical provinces and cities from three aspects,including IP-related public policy,public policy in the IP field,and public policy in the field of patent,and summarizes their core contents.This paper also reviews and analyzes comparatively the five elements of environment,market,motivation,human resources,and information to present a clear policy system,laying the foundation for later analysis and optimization of the policy.Finally,an optimization path of public policy for patent service of Guangdong province is proposed.On the basis of general policy optimization theories and in combination of the practical situation of Guangdong province,this paper proposes an overall goal,the basic principles,and the guiding ideology for optimizing the public policy for patent services.Then,based on the five specific elements,i.e.,the environment,market,motivation,human resources,and information,in view of the subject and object-related factors,the public policy for patent service in Guangdong province is specifically optimized.The direction and specific measures for future improvement are proposed.Accordingly,a reference for improving the theory system of the public policy for patent services and further promote the innovation and development of patent services.
