Research On The Optimization Of Patent Funding Policy From The Perspective Of Intellectual Property Administration

Innovation is the primary driving force for development,and protecting intellectual property rights is protecting innovation.No innovation can be separated from the guidance,encouragement,promotion and protection of intellectual property policies.Because patents are highly technical and professional cross-cutting nature,it is difficult to create,be used and protected,which is an extremely important part of intellectual property work.In order to protect the legitimate rights and interests of patents and promote local economic development,various regions have issued a series of patent funding policies to encourage innovative subjects to create high-value patents,help patents exert their economic value,and protect the legitimate rights of patents,so as to promote the continuous development of local patent work.Since the institutional reform in 2018,China has fully realized the "two-in-one" intellectual property administrative management system for patents and trademarks.The intellectual property policy system has been further improved,the administrative enforcement of intellectual property rights has become more centralized and unified,the administrative efficiency of intellectual property rights has become more efficient,and the promotion of patent work has paid more attention to the improvement of quantity and quality,transformation and protection,and the patent funding policy has also been continuously revised and improved,paying more attention to guiding the high-quality creation of funding objects,minimizing rent-seeking and speculation,and giving play to positive effects such as encouraging innovation and promoting scientific and technological progress.This paper takes City B as an example and mainly studies the optimization countermeasures of patent funding policy from the perspective of intellectual property administration,and uses the current general analysis framework of patent creation,application,protection management and service as the whole life cycle of patents,and uses the analysis methods such as questionnaire survey method,interview method,literature research method,and system analysis method,and uses public choice theory,public goods theory,incentive theory and other related theories.Taking the patent funding policy of City B as the main research object,combined with the characteristics of economic and industrial development in City B,intellectual property administration,patent funding cashing and other work status.this paper deeply analyzes the current changes in patent funding policies in City B before and after institutional reform,collects relevant historical patent data after the introduction of patent funding policies in City B,understands the views and suggestions of stakeholders in patent work in different fields such as relevant government departments,patent service institutions,and enterprises of different scales,and combines the patent funding policies of different types of cities.It reflects the positive effect of the current patent funding policy in promoting patent work in City B,analyzes the problems and influencing factors existing in the current patent funding policy,and provides suggestions for the relevant administrative departments on the optimization of patent funding policies.Based on the comparative study of the previous patent funding policy and patent development data of City B,combined with the results of the questionnaire survey,this paper argues that under the current policy background and development reality,the implementation of patent funding policies in City B is helpful to guide innovative subjects to continuously improve the quantity and quality of patents,improve the level of patent management and application,and promote the continuous progress of local patent work.At the same time,it is also found that the current patent funding policy still has some problems such as insufficient guidance for high-value patents,small proportion of patent transformation and protection,weak effective incentive to innovation subjects,and low efficiency of funding methods and processes.Therefore,after analyzing the factors such as the purpose of the funding policy,the functions of administrative management institutions,the level of local economic development,and the motivation of right holders to apply and other factors,suggestions are put forward to strengthen the orientation of high-value patent cultivation,increase the proportion of post-creation funding of patents,increase the incentive effect on innovation subjects,and optimize the subsidization method and cashing process.
