Research On The Development Of The Socialist Culture Of Rule Of Law With Chinese Characteristics

The socialist culture of rule of law with C hinese characteristics,an important issue that can not be avoided in the process of civilization of the rule of law,is the soil which cultivates the development of the rule of law.As a soft power of the rule of law,the culture of rule of law is an important theoretical foundation for democracy and the rule of law.It also serves as an important part of the modernization of the state governing system and plays an irreplaceable role in the rule of law in China.As an important part of cultural development,the socialist culture of rule of law with C hinese characteristics has become a cultural phenomenon that has been emphasized by both academics and authorities.The theoretical consciousness of studying the development of culture of rule of law lies in the realistic response to the development of contemporary rule of law in C hina,which is to provide the relevant academic support for more effectively cultivating the culture of rule of law.Based on the basic theory of culture of rule of law,this paper expounds on the necessity and the logic ways to develop the culture of rule of law and puts forward the path of developing the socialist culture of rule of law with C hinese characteristics.In doing so,it sheds light on the thought of Marxist culture of rule of law and its creative transformation,borrowing from both the C hinese traditional thought and the western thought on the culture of rule of law.The culture of rule of law,a concept with multiple internal structures as well as rich and profound connotations,is not only a kind of governing culture but also a kind of cultural consciousness.As far as state governance is concerned,the culture of rule of law as a strategy of running the country is different from the cult ure of governing by man.As a way of life it is different from the culture of rule of virtue.In the light of cultural practice,the culture of rule of law,as a mental outlook,comes from individual consciousness.This paper defines the culture of rule of law both broadly and narrowly.In the broad sense,the culture of rule of law is a cultural phenomenon and the state of the rule of law includes the material culture of rule of law,the system of culture of rule of law,the spiritual culture of rule of law and the behavioral culture of rule of law.In the narrow sense,the culture of rule of law is a cultural phenomenon and the state of the rule of law is governed by the unity of the results of spirit ual civilization and the way of behavior in the rule of law.In the process of building a modern socialist China,the culture of rule of law not only has the function of general culture,but also has the specia l function that culture does not have.Therefore,it is necessary to optimize the structure of the culture of rule of law and enhance its functions,which plays a key guiding role and provides a spiritual support for the development of the civilization of rule of law.The socialist culture of rule of law with Chinese characteristics,based on the thought of Marxist culture of rule of law,inherits the outstanding elements from the traditional C hinese culture of rule of law and the wes tern ideas of the culture of rule of law.The thought of Marxist culture of rule of law can be traced back to Marx and Engels' thought of the culture of rule of law,Lenin's thought of the culture of rule of law,the thought of the culture of rule of law of Mao Zedong and o ther proletarian revolutionaries,and the thought of the culture of rule of law of leaders of C hinese Communist Party since the reform and opening up.O f course,their vie ws on the culture of rule of law are mainly based on their practical needs.Therefore,the thought of Marxist culture of rule of law can only be treated from their related discourse on the culture of rule of law.The traditional C hinese thought of the culture of rule of law has a profound cultural foundation,and the foundations of the modern C hinese culture of rule of law must go to the treasure house of thoughts in C hinese history.The beneficial fruits of western thought on the culture of rule of law which offer us more enlightenment,should be critically used for reference,with the reasonable components carefully absorbed.The great practice of the socialist culture of rule of law with C hinese characteristics originated in the era of the new democratic revolution.During the period of socialist revolution and construction,the great practice of the culture of rule of law gradually came into being and finally came up with a new era of reform and opening up.The historical tasks of different stages of the development of the culture of rule of law concretely stipulate the practical contents of the culture of rule of law which are of the same strain and have their own characteristics.Due to the short time of its proposition,the socialist culture of rule of law with Chinese characteristics is faced with various difficulties both in theory and in practice.At present,there is no index system in our country that independently evaluates the culture of rule of law.This paper intends to analyze the assessment data of the rule of law so as to determine the development of the culture of rule of law in C hina,which can only be a reference index.According to the existing assessment data of the evaluation system of international and domestic rule of law,the situation of t he culture of rule of law is not optimistic and there is a gap with other countries.In that the development of the culture of rule of law in colleges and universities has the great impact on society,a sample survey of college students in colleges and universities is conducted to find out the true status quo of the culture of rule of law in our country in this paper.On the basis of this,we analyze the prominent problems and causes of the culture of rule of law in our country.The development of the socialist culture of rule of law with Chinese characteristics is divided into the material culture of rule of law,the system of culture of rule of law,the spiritual culture of rule of law and the behavioral culture of rule of law in terms of contents.All these levels constitute a unified culture of rule of law as a whole,and are interconnected,mutually transformed and mutually restrained.For the development of the culture of rule of law,it is not enough to study only this issue,we should also conduct an in-depth study on the structure of the culture of rule of law: sound lawmaking,strict law enforcement,impartial administration of justice,and the observance of law by everyone.Among them,sound lawmaking is the solid foundation for the development of culture of rule of law,strict law enforcement is the support of the development of culture of rule of law,impartial administration of justice is the bottom line of the development of culture of rule of law,and the observance of law by everyone is the goal of the development of culture of rule of law.Only in this way can we have a profound understanding of the process of forming a culture of rule of law and make better use of the building of the culture of rule of law to serve the rule of law in China.To develop the socialist culture of rule of law with C hinese characteristics,it is necessary to combine the universal laws with the special conditions of our country.We should also adhere to the principles of CPC leadership in the development of the culture of rule of law.To promote the development of culture of rule of law,importance is attached to the material,institutional,spiritual and behavioral levels.Firstly,we should make efforts to promote the development of the culture of rule of law of organization at the material level.Secondly,we should make efforts to promote the development of Chinese democracy and the rule of law at the institutional level.Thirdly,we should make efforts to promote the development of the rule of law of the humanistic thinking at the spiritual level.Fourthly,in view of the culture of rule of law at the behavioral level,we should make efforts to promote the practice of the rule of law for the actors.The development of the socialist culture of rule of law with Chinese characteristics is a dynamic process.In order to achieve the standardization and scientification of development,it is necessary to establish a set of operational mechanisms that are coordinated and mutually influencing each other.These mechanisms include: the motivation mechanism,the transmission mechanism,the innovation mechanism and the guarantee mechanism.In short,the development of the socialist culture of rule of law with Chinese characteristics is a system-wide project.The long and unique cultural tradition and complex national conditions determine the arduousness of the development of the culture of rule of law for a new era.We can not promote the culture of rule of law by means of individual measures and individual actions with a single force.Instead,the development of the culture of rule of law should give full play to the synergistic forces and establish a sound mechanism for everyone to participate in the development of the culture of rule of law.The core value of the culture of rule of law is to realize the civilization of rule of law.O nly by making efforts to develop an innovation system for the development of the culture of rule of law,carrying forward the fine cultural traditions a nd moving with the times,can we truly enter the new era of the unity of truth,goodness and beauty,and achieve the welfare of the entire society.
