On The Low-carbon Legislation Of China

In recent years,climate change has become a major global issue of common concern to the international community.To cope with climate change and seize the advantageous position in the development of low-carbon economy,the rise of a wave of low-carbon legislation has been booming internationally.Many countries,especially the developed countries have been strengthening low-carbon legislation.In order to cope with climate change and control carbon emissions,international governmental and non-governmental organizations,which include International Organization for Standardization(ISO),continue to strengthen the research and formulation of low-carbon standards for footprint and low-carbon certification,etc.In multilateral and bilateral negotiations held by the United Nations Framework Convention on Climate Change and other convention,treaty and multilateral and bilateral organizations,dealing with the issue of climate change and controlling carbon emissions is usually regarded as very important.Study and formulation of international low-carbon rules has become the general trend.International low-carbon legislation will have a growing impact on the economy and trade of every country.As the second largest economy,the largest country in goods trade as well as carbon emissions in the world,China will bear the brunt.Although China has made some progress in low-carbon legislation,there are still shortcomings such as lack of basic law,imperfect legal system and legislation idea lag,etc.It is difficult to adapt to the needs of China’s response to climate change and sustainable economic and social development.Therefore,it is undoubtedly of great significance to study and learn from international experience of low-carbon legislation,promote the theoretical research and legislative practice of low-carbon legislation in China.In this paper,some specific proposals for the low-carbon legislation of our country have been put forward by learning from international experience and basing on national conditions.The paper has used comparative and other research methods from the perspective of international law,through the research and analysis on the international low-carbon legislation and standards and the related problems on China low-carbon legislation.This thesis includes a total of six chapters.Chapter 1 is an introduction to theresearch background and significance,domestic and foreign research review and research ideas,contents and methods.It also points out the main innovation and insufficiency of this paper.Chapter 2 analyzes and explains the legal theoretical basis and practical significance of China’s low-carbon legislation on the basis of clarifying the related concepts on low-carbon legislation.Chapter 3 makes a comparative study of international low-carbon legislations from the legislative principles,orientation and other aspects,and evaluates its reference value and enlightenment to China’s low-carbon legislation.Chapter 4 makes a comparative study of international low-carbon standards and evaluates its reference value and enlightenment for China to strive for international voicing right and construct its own low-carbon standards.Chapter 5 analyses and discusses the necessity and principles of the low-carbon legislation in China.Chapter 6 puts forward some concrete suggestions to China’s low-carbon legislation based on the national conditions and by analyzing the existing related low-carbon legislation of China.In addition,this thesis also attached a "low carbon development law" draft.
