On the basis of the Food Hygiene Law of the People’s Republic of China, draw- ing on the experience of developed countries ,combining it with our reality, absorbing much experience, after full study and many years of revisions, deliberations, the Food Safety Law of the People’s Republic of China has taken into effect on June 1, 2009 eventually. This will not only further improve our countries’food safe legal institution of system, but also provide with basis for building long -term mechanism and legal barrier. At present, with frequent occurrence of food quality and safety accidents, the aquatic products’quality and safety are not satisfying, in this context, the law plays significant role in regulating the aquatic products’quality and safety.As background materials, we first analyzed the background and concrete evolut- ion of the food safety law, and the present situations of our countries’aquatic product- s’quality and safety. Secondly, we analyzed the newly introduced Food Safety Law of the People’s Republic of China with the theory of the incomplete law, and make a preliminary introduction about the applicability of the food law in the regulation of the aquatic products’quality and safety; with the asymmetry information theory and game theory, economic analysis was made about our countries’aquatic products’quality and safety. We established the corresponding theoretical basis for the research of the aquatic products’quality and safety from the above three aspects.This paper summarized the accumulated experience of America, Europe and Japan in the field of regulation of the aquatic products’quality and safety through administrative organization, the laws and regulations, standard, detection, authentica- tion, risk analysis, traceability system, product recall system and pre-warning system. Then we analyzed the present situations of our countries’regulation of the aquatic products’quality and safety. We surveyed the related regulations, laws and department rules; summarized the agencies which make detailed regulatory work on aquatic products’quality and safety and law’s regulation ,the developing process of standardization and the present standardization of our countries’standardization of aquatic products.By collecting and arranging the quality measurement systems of agricultural pro- ducts, food and the aquatic product, summarized the present situation of the inspection system of the aquatic products; From the development, the laws and regulations about certification and accreditation, the present station of the aquatic culture field’product certification and system certification, we analyzed the current status of the aquatic products’accreditation and certification, and discussed the aquatic products’traceability,recall and announcing information on the quality and safety.On the basis of foreign advanced experience, combined with the current status of our countries’regulation of the aquatic products’quality and safety, pondered the ex- isting problem during the regulation, and with the regulation reforms after the intro- duction of the Food Safety Law of the People’s Republic of China, we provide some suggestions for the regulation of the aquatic products’quality and safety.At last, take the example of the regulation of turbot culture, we analyzed the current regulatory of turbot culture begin with the turbot incident. We summarized the laws, regulations, department rules and the related rules of standard ,and the regulators on environment, inputs and primary products of turbot culture, analyzed the implementation of related authentication, summarized the current regulatory and further analyzed the problem of turbot culture, made corresponding suggestions for the regulation of turbot culture.
