Study On Science And Technology Supporting System For Maritime Law Enforcement

At present, marine development has become the focus of attention of the marine national strategic layout. Depending on comprehensive strength, especially the power of science and technology, the competition for marine interests and space comes into perfervid condition. "Blue enclosure" staged in the global scope. Maritime rights and interests of our country is facing severe and urgent situation, including resource contention, maritime demarcation, islands sovereignty, and strategic channel security etc. The escalating dispute and prevalent infringement has caused a severe test of China’s marine rights. The report of the 18th Party Congress of China stated the construction of marine power for the first time and proposed to resolutely safeguard China’s maritime rights and interests in the national development strategy height. Maritime law enforcement is the basic measures and necessary means to safeguard marine rights, which needs powerful support from advancing marine science and technology. In the current severe situation of marine rights protection, it is both practically and theoretically important to construct maritime law enforcement support system of science and technology, and promot the innovation of marine science and technology.This paper establishes close correlation between marine science and technology development and marine rights protection and law enforcement and elaborates the important direction and field of marine science and technology that should be concerned from a new perspective of law enforcement, by using standard analysis method, empirical analysis method, comparative analysis method, research analysis method, and data collection method etc.This paper begins with the relevant theories of marine rights and interests and marine science and technology, and further elaborates the connotation and development of the marine rights and interests, United Nations convention on the law of the ocean and seas, China’s maritime rights and interests etc, analyzes law enforcement connotation, characteristics, main task and marine technology parameters, and clarifies the meaning and content of the maritime law enforcement support system of marine science and technology. We put forward the maritime law enforcement support system of marine science and technology including the marine science and technology management and policy subsystem, marine science and technology resources and investment subsystem, marine science and technology talent and ideas subsystem, law enforcement equipment and technology subsystem, assessment and evaluation subsystem and so on. We study the characteristics and experience of other world marine powers like United States, Japan, Britain, and South Korea in aspects of maritime law enforcement support system of marine science and technology, which provides the reference for our country to build our own support system. This paper uses SWOT model method to analyze the strengths, weaknesses, opportunities and threats of China’s marine rights support situation of marine science and technology.Based on above knowledge, we summarize and analyze the tentative plan of the maritime law enforcement support system of marine science and technology. Considering the significant demand for marine national security and law enforcement through the implementation of marine science and technology innovation, the overall goal is to enhance the supporting role of law enforcement of marine science and technology, to greatly improve the ability of marine law enforcement of marine science and technology in response to the situation changes, enhancing the defense ability, dealing with unexpected problems, effective law enforcement and disposal and so on. The construction of the maritime law enforcement support system of marine science and technology that retains Chinese characteristics needs to perfect the theory and policy, strengthen the input of resources, pay attention to personnel training, and enhance the soft support ability of science and technology. It also needs to enhance the hard support capacity of science and technology by improving the marine technology security level of marine law enforcement forces, including upgrading law enforcement equipment and platform technology, enhancing the technology ability of monitoring and early warning, command and communication, law enforcement forensics, interference technology, security level of marine environment and so on. The assessment of the implementation of the support system is an important security subsystem. The construction of the support system is conducive to create a high level of law enforcement power and research and development strength, the formation of marine science and technology innovation system, providing powerful support for the security of our country’s maritime rights and interests and security.This paper puts forward the suggestion and safeguard measures which are suit to China of the construction of the maritime law enforcement support system of marine science and technology, including deepening the reform of evaluation mechanism, enhancing the innovation driving level, enhancing the capability of independent innovation, accelerating achievement of industrialization, improving resource sharing mechanism, advancing regional cooperation, the implement of marine talent strategy, building innovation driven kernel, expanding international cooperation and exchanges, supporting a greater say in international affairs and so on.
