Research On Thought On Legal System Of The First Generation Of Leaders Of The Communist Party Of China

Thought on legal system of the first generation leaders of the communist party of China(CPC) is the thought on revolutionary base areas and New China’s legal system construction of the first generation of leaders of the CPC mainly represented by Mao Zedong. During the long historical process of leading Chinese new-democratic revolution, socialist revolution and socialist construction, the first generation leaders of the CPC mainly represented by Mao Zedong illustrate a series of issues on legal system construction of revolutionary base areas and new China, and form the thought on legal system construction of revolutionary base areas and new China, which is application and development of Marxism-Leninism’s legal theory in China, is summary of experience of the first generation leaders of the CPC, is the crystallization of collective wisdom of the CPC, is the most important component of Mao Zedong thought.The legal thought of the first generation leaders of the CPC, plays an important leading role in legal system construction of revolutionary base areas and new China, also plays an important security role in new-democratic revolution, socialist revolution, socialist construction, and a series of achievements. Researching on the legal thought of the first generation leaders of the CPC has certain theoretical value, for our understanding the development and the contents system of the thought, evaluating the thought’s success and failure, summarizing historical experience and lessons, which also has certain realistic significance for carrying out the spirit of the fourth plenary session of the eighteenth and wholly promoting ruling the country by law. The paper is composed of five chapters.Chapter one, historical conditions for the existence of the thought. This chapter illustrates that Marxism-Leninism legal theory and Chinese nation’s excellent legal thought heritage are the theoretical condition. Legal system construction practice in revolutionary base areas, construction practice at the beginning of founding of new China, and construction practice after socialist rebuilding are practical foundation or practical condition of the thought.Chapter two, legal thought of the first generation of leaders of the CPC in the period the new-democratic revolution.
