The Research On The Relationship Between China's Copyright System And Development Of Copyright Economy

At the late 20th century, the popularity of computer technology, the coming of digital era and the popularity of Internet technology make the world economy enter the era of knowledge economy. The copyright then has become important economic resources. There is fundamental change worldwide. Copyright Economy first emerged. In the meantime, China has just begun the construction of basic rights. Entering the new century, because of the impact of information technology and the emerging of new forms of industries, unsound "traditional" copyright system (Aiming at copyright products with paper the media) has shown its maladjustment to the new technology. Under the new technical situation, the expanded effect of original copyright system of our country emerged. For the fact that the copyright system of our country, that is the law system of copyright protection, was set up according to the international needs, there exists maladjustment to real needs. This kind of situation appears obviously in the new digital technique development era. For example, some work with unclear property right on network and Digital library are even more difficult to define. The law even does not have the stipulation of corresponding property right ownership. The basic reason of this situation is that the ownership of books property right is unclear, the division is not very explicit, and new numerical code technology platform appears, but the related stipulation of copyright protection does not catch up with them correspondingly. Faced with this situation, we must reform the copyright system.The work of the author is around to examine a series of problems existing in current copyright regime of our country from the process of establishing and improving copyright system, for example unsound laws and regulations for protecting copyright and self-contradictory of provisions in copyright system construction and inadequate copyright protection. The author's view is that a national copyright system should first meet local demands. Just because of this, the problems of each protection system of copyright could find the environment and situation at the beginning of establishment. Currently, copyright system in our country faces dual impact of digitization and the internationalization. The inadequate and insufficient points exist in copyright system of our country, which could affect the overall development of the copyright economy. In addition to analysis of China's copyright regime in the process of development, it also conducts comparison research according to current international development and development of other countries. It especially conducts detailed analysis about the development and reform of copyright system of the U.S. Through the experience of other countries and the corresponding explore of international situation, defects and weaknesses existing in our country are explored. Some suggestions about reforms are put forward to deal with these defects, which is the basic starting point of the paper. Through the defining of rational system of use, collective management system of copyright, setting of copyright deadline and new property right relationship under new technology, seek new breakthrough of reform. The above-mentioned mechanism establishment and reform promote trade efficiency of copyright products, promoting economic development and conducting protection for creative incentives and property rights of copyright owners.The innovation points of the paper are as follows:(1) This paper mainly connects interest relationship in many ways. Through basic economic meaning of copyright system and diachronism analysis of copyright system, it is concluded that construction of copyright road to economic construction. By using relevant law, sociology, political science research, the paper uses way of economics to related reform of copyright system. We can regard the development of economic copyright and development of copyright system as different angles of one same process. Development of copyright economy needs definition and protection of property rights relationship, management system, correct of violation. Copyright reform is the solution and guide in the process of economic development.
