Research On The Legal Problems Of Water Resources Management System

Water is a very important natural resource for human,value and meaning is self-evident.However,due to the over-exploitation of water resources by mankind,water resources are drying up.Therefore,the water can not damage the ecological balance of the premise for development,protection of water resources for sustainable use for human, become a common topic for all the world.At present,China's water situation is worried,the increasing scarcity of water resources,water quality declining,the continued deterioration of the water environment, and water allocation unreasonable.In addition,due to the inefficient use of water resources and water resources management system problems, resulting in a serious waste,and further aggravated the shortage of water resources.The shortage of water resources has become a bottleneck for China's economic development.To regulate the development,to maintain water balance in the ecological system,it is necessary to build a scientific and rational water management system.Water resources management system is the central and local departments and enterprises in water resources management and protection,authority duties,and mutual interests.Between the guidelines on the management of water resources of organizations,division of authority and management duties.Before China's new "Water Law," the Ministry,basin and local water administration departments management at different levels on the classification system."Water Law" in 2002 establish a new water management is integrate the management and administrative management system.However,China's current legal system is still lacking on the water resources management system,must be improved. At present,China's water resources management system,there are many problems,such as water management agency status is not clear, responsibility between the executive branch is not clear,the majority of poor operational terms,the relevant legal linkage between laws,the law is relatively backward,and so on.In light of the grim situation of water resources in China,based on the current situation of China's water resources management system and the problems that exist,and learn from useful experiences of developed countries on the basis of the water resources management system,then research the reform and development of China's water resources management system.In this paper,research from a new "Water Law" on the water resources management system as the basis and starting point,then combined with relevant laws and regulations,advised that water resources management system should be clear guiding principles management of water resources,establish the legal status of functions, revise and improve existing laws,and coordination of the relationship between the laws and regulations.Only by constantly Improving our water management system be able to better protect water resources,and promote the sustainable development of water resources and sustainable use.
