The development plan of the catering industry in Heilongjiang Province(2019-2025)proposes that by 2025,the total revenue of the catering industry in Heilongjiang Province will reach 100 billion yuan,with an average annual growth rate of more than 10%,and the number of employed people in the catering industry will exceed that 1.5 million people.In 2020,Heilongjiang Province issued Several Policies and Measures to Accelerate the Development of the Service Industry in Heilongjiang Province,which clearly stated that the catering industry is an important part of the service industry,proposed to accelerate the digital transformation and brand building of the catering industry,and promote the integrated development of the catering industry with tourism,culture and other industries.As a mecca for ice and snow viewing in Heilongjiang Province,Harbin has special food and health meals that are the warmth and love of tourists;At the same time,dine-in,takeaway,prepared dishes and semi-finished products also meet the diversified needs of Harbin people’s catering,and the catering industry has gradually become an important industry to expand domestic demand,promote consumption,stabilize growth,and benefit people’s livelihood.According to the estimates of the Harbin Municipal Bureau of Commerce,there are more than 50,000 catering enterprises in Harbin,most of which are private units,small and micro enterprises,and there are many self-employed,employing more than 400,000 people.The new generation of migrant workers has become the main body of grassroots employees in Harbin’s catering industry,and they can adapt to electronic recipes,electronic ordering,and POS The use of intelligent equipment such as machines is the preferred employment object of large-scale catering enterprises and chain catering enterprises.However,the catering industry is a traditional labor-intensive industry,long business hours,weekends and holidays are the peak consumption season of the catering industry,workers work long hours is the norm,the right to rest and leave cannot be guaranteed,social insurance coverage is not high,career development planning and other rights and interests cannot be guaranteed.As a new force in Harbin’s tertiary industry,the catering industry protects the labor rights and interests of the new generation of migrant workers,which is of great significance to the urban integration of the new generation of migrant workers,the service quality of Harbin’s catering industry and the common prosperity.Taking the new generation of migrant workers in catering enterprises in Harbin as the research object,based on labor process theory,labor market segmentation theory,push and pull theory,humanistic theory,literature research,investigation and analysis are used Fieldwork and other research methods expounded the current situation of labor rights protection of the new generation of migrant workers in Harbin catering enterprises,and found that the labor rights and interests of the new generation of migrant workers in Harbin catering enterprises have high work intensity and poor working conditions,low labor remuneration and low welfare level,and damage to the right to rest and vacation problems such as the persistence of discrimination in employment;Through field survey data and multiple linear regression analysis methods,the influencing factors of labor rights protection of the new generation of migrant workers in Harbin catering industry were empirically analyzed,and the results showed that the length of working hours was short The two variables of whether or not to pay social insurance have a significant impact on the protection of labor rights and interests of the new generation of migrant workers in Harbin’s catering industry.On this basis,the countermeasures to improve the protection of the labor rights and interests of the new generation of migrant workers in Harbin catering enterprises are proposed,mainly including:giving play to the main role of the government in improving the protection of the labor rights and interests of the new generation of migrant workers;Improve the awareness of responsibility and brand of catering enterprises in Harbin;The new generation of migrant workers in the catering industry improves their ability to protect their rights and interests;Compensate for the lack of social support.Improve the employment quality of the new generation of migrant workers in the catering industry and improve people’s livelihood and well-being.
