The negative externalities of land use require state intervention to prevent market failure and safeguard public interests.China’s land system arrangement is closely related to the national will,highly involved in the internal property rights,emphasizing public interests over private interests,and changing the distribution of wealth.In the past few decades,this model of land control has played an important role in promoting urbanization and economic growth.Today,when the economy has entered a new normal and unbalanced and inadequate development has become the main contradiction in society,land is no longer the engine of economic growth,and private interests are too suppressed to meet the overall demand of stimulating domestic demand and promoting economic and social progress.Therefore,it is necessary to change the logic of land control in the past,rethink the relationship between public and private interests in land control,and improve the current land control system to promote the unity of public and private interests.Contradiction of Marxism,this paper analysis the relationship between public and private interests in land control,think the two as the two sides of contradiction,interdependent fight each other,not simply think that which is preferred,but combined with analysis of the relationship between socioeconomic status on the role of social progress,the flexible use of government regulation and market mechanism configuration of land resources.Based on a thorough investigation of the changes of land system since 1949,it is found that the contradiction between public and private interests of land control has experienced four periods: invisibility,emergence,intensification and adjustment.At present,the main performance of the relationship between the two is that public interests suppress private interests,mainly for three reasons: first,the land property right system has the residue of planned economy,and the land control is easy to intrude into the property right system;Second,the failure of government regulation will lead to the distortion of the public interest it represents,and the scope is often expanded;Third,the lack of interest compensation mechanism,the burden between land owners is not balanced and has not been adjusted.The development dilemma faced by Y Community in Chengdu High-tech Zone due to multiple land controls supports the above views.Based on the above research,this paper proposes to construct a balance mechanism of public and private interests in land control according to the logic of "promoting the expression of private interests--standardizing the content of public interests--establishing the interest compensation system",which mainly includes three sub-mechanisms.That is,the private interest expression mechanism following the principle of equal protection of property rights,the public interest regulation mechanism following the principle of public interest is not equal to power,and the interest compensation mechanism following the principle of fair burden and equality,so as to ensure the unity of public and private interests in land control.One of the possible innovations of this paper is the systematic elaboration of public and private interests in land control from the theoretical perspective of interest contradiction.The second is to construct the mechanism framework of three links: "promoting the expression of private interests--standardizing the content of public interests--establishing the interest compensation system",so as to logically connect the land control and form a logical closed loop for each link.The main deficiency of this paper is that it does not use the quantitative analysis method to conduct empirical test,and the public-private interest balance mechanism constructed is not innovative enough and not specific enough.
