A Study On Taiwan Zone Expropriation

With the development of urbanization and industrialization in Taiwan of our country,people’s awareness of maintaining the legal right of private property is increasing,which makes it more difficult for government agencies to obtain public land.Traditional land expropriation system has been unable to meet the needs of reality,but the idea of "price rise to public" has become more and more popular.On this basis,Zone Expropriation arises at the historic moment.The Zone Expropriation System in Taiwan is a new system,which has important reference significance for Tract Development of mainland area.Based on the method of literature research,historical analysis and comparative research.First,through the research and analysis of the literature on the Zone Expropriation System in Taiwan,it sorts out the expropriation procedures,compensation models and relief mechanisms involved in Zone Expropriation theory,and strive to make a complete and detailed discussion of the Zone Expropriation System and its specific operation mode.Secondly,it discusses the advantages of the extremely flexible compensation mode of land expropriation in the Zone Expropriation System,and also points out that the Zone Expropriation System has problems such as the purpose,procedure and responsibility positioning.Finally,based on the advantages and disadvantages of the Zone Expropriation System,the current situation of the Tract Development in the mainland area is improved and perfected accordingly.At present,Tract Development can be carried out in four aspects: First,drawing on the experience of the compensation mode of the land for sale,and improving the area ratio,location allocation and allocation supervision of the reserved land in Tract Development;Second,clarify the responsibilities of the government,private developers and village collectives in Tract Development;Third,it makes detailed provisions for the review of the rationality and necessity of the expropriation purpose of the Tract Development;Fourth,in order to ensure the legitimacy of Tract Development through the participation and supervision of the public,it is necessary to add the system of consultation price purchase and public hearing.This thesis has 3 figures and 50 references.
