Research On Copyright Infringement And Protection Of Film And Television Editing In Short Video Platforms

In recent years,with the popularity and rapid development of the Internet,driven by a series of high technologies such as 5G communication technology,big data and artificial intelligence,short videos have shown rapid development by virtue of their fragmented reception,immersive experience and other communication characteristics,and platforms relying on short videos as communication contents have come out on top in the fierce competition of the Internet.With the wave of short video development,the popularity of video clips has soared,but at the same time,the copyright infringement issue has become increasingly prominent,and some controversial and uncertain contents often appear in China’s current relevant legal practice.Through the methods of literature analysis,case study and comparative analysis,we investigate the problem of infringement and protection of short video clips in short video platforms.We analyze the attributes of short video clips and related legal cases,and propose the protection of copyright of short video clips from three levels: creators,platforms and copyright owners;on the other hand,we make reasonable suggestions for the regulation of infringement of short video clips from the legal level,in order to create a harmonious On the other hand,we make reasonable suggestions on the regulation of infringement of short video clips from the legal level,so as to create a harmonious short video network environment and promote the healthy development of China’s cultural industry.Excluding the introductory part,the main content includes the following chapters.The first chapter is an overview of short video clips: it mainly analyzes the definition and specific classification of short video clips,summarizes the specific characteristics of short video clips,and analyzes the substantive and formal elements of "works" in copyright law,further analyzes the composition of short video clips,and discusses whether they belong to "works" protected by copyright law.It further analyzes the composition of video clips and discusses whether they are "works" protected by copyright law.Chapter 2 analyzes the copyright infringement of short video clips: on the one hand,the copyright infringement is divided into direct infringement and indirect infringement,and the relevant rights of copyright owners that may be infringed by short video clips are specifically analyzed;on the other hand,the infringement case of "Yunnan Bug Valley" is combined with a case study and summarized.On the other hand,the infringement case of "Yunnan Bug Valley" is discussed in depth and summarized.The third chapter is a study on copyright protection of short videos of film and television clips: from three aspects: regulation of creators’ creative behavior,risk prevention of short video platforms and self-protection of copyright owners of film and television dramas,specific protection measures are proposed to reduce the risk of copyright infringement.The fourth chapter is a proposal for the improvement of the relevant laws of China’s copyright law:combining the relevant laws at home and abroad,the research of scholars in the industry and the relevant legal practice,we will improve the judgment standard of "originality" of works,the fair use system and the "safe harbor rule" from three aspects.In this paper,we propose a rationalized proposal for the regulation of infringement of short video clips.
