| On June 24 th,2022,the newly revised Sports Law of the People’s Republic of China was promulgated and implemented.It is an important measure to implement the basic strategy of comprehensively governing the country according to law,an important way to solve the problem of insufficient imbalance in sports development,and an important guarantee to improve the modernization level of sports governance system and governance capacity.It marks that the construction of sports rule of law in China has entered a new stage of development,which is of great significance to standardize and lead the high-quality development of sports in the new era and accelerate the construction of a sports power and a healthy China.In order to make students develop morally,intellectually and physically in an allround way,governments at all levels and colleges and universities have incorporated physical education into the overall teaching of schools.At present,the number of college students participating in sports activities is increasing day by day.They are young people in the new era,full of energy and love sports.However,because they have been living in school,their awareness of risk prevention and risk response is still relatively lacking,and they are still at a loss about the accidents that happen to them.In the sports activities of college students in China,the incidence of injury accidents is on the rise,and the injuries are often explosive,which brings indelible trauma to their bodies and spirits.In an accident,there will inevitably be disputes,and the cause of the disputes is probably that the parties responsible for the accident have not reached a consensus on the solution.The main factors causing sports safety hazards are: the main responsible person of the accident cannot be clearly defined;No matter what factors cause disputes,they will have a certain impact on college students’ study and life,do some harm to their body and mind,have a certain impact on the normal education of universities and the normal development of society,and also do some harm to the overall image of universities.This paper mainly uses the case analysis method to identify 44 cases of college students’ sports injury accidents related court judgment documents,and to find relevant literature,policy documents and laws and regulations,and to study and analyze them,and finally get the following conclusions:1.There are more cases of college students’ sports injury accidents in provincial capitals than in local cities,which are concentrated in East China and South China.The average trial time of college students’ sports injury accidents in China is 2.5 years.2.Extracurricular activities are the most common organizational form of sports injury accidents among college students in China,followed by sports competitions;The most vulnerable parts of college students’ sports injuries are the five senses,followed by the limbs;College students’ sports injuries and disabilities are classified into minor injuries,disability and death.3.There are three dimensions of sports injury accidents of college students in China,namely,internal cause,external cause and comprehensive factor.4.The responsibility of college students’ sports injury accidents in China is identified as school responsibility,student responsibility and mixed responsibility.5.The problems existing in sports injury accidents of college students in China are as follows:(1)Students’ safety awareness is poor;(2)Teachers’ professional quality is not high;(3)The sports management system is not perfect;(4)The facilities of stadiums and gymnasiums are seriously aging.Preventive measures for college students’ sports injury accidents:(1)Strengthen the popularization and guidance of college students’ safety education;(2)Strengthening the professional quality of college PE teachers;(3)Strengthen sports management to ensure students’ safety;(4)Strengthen the management of sports facilities. |
