Research On The Administrative Law Enforcement Power Of Township Government

The township government is the most basic executive branch in our system of government organization.It undertakes a large number of administrative functions,but lacks the power to enforce the law for a long time,law Enforcement at the grass-roots level appears the dilemma of“Those who can not see and those who can see can not control”.Therefore,our country carries on the law enforcement power to sink to the township government’s reform.This article takes the township government administrative law enforcement power as the research object,the main content includes the following five parts.The first part is the introduction,which mainly introduces the background of the thesis and the significance of the research,and summarizes the main references,such as monographs,journal thesis,degree thesis,etc.,and makes the analysis,explains the thesis structure and each part main content,elaborates the research method which the thesis uses.The second part is the basic outline of the power of law enforcement of township government.This thesis expounds the connotation of administrative law enforcement power and the legal nature of administrative law enforcement power sinking to township government,and defines the concept of township government administrative law enforcement power.This thesis discusses the importance of the township government exercising the power of administrative law enforcement.This part tries to lay a foundation for the study of the administrative law enforcement power of the township government.The third part is an introduction to the process of exploring the rule of law in the administrative law enforcement power of township governments.Initially,township governments exercised their administrative law enforcement power through entrusted law enforcement.Although entrusted law enforcement can meet the law enforcement needs of township governments to a certain extent,the problems with the entrusted law enforcement model of township governments have determined that the entrusted law enforcement model is difficult to adapt to the increasing law enforcement power needs of township governments and meet the goals of comprehensive administrative law enforcement system reform.In this context,China has initiated a reform to lower the enforcement power to the grassroots level.The fourth part analyzes the problems and causes in the practice of administrative enforcement power of township government.On the basis of reviewing the reform achievements of law enforcement power sinking in various places,this paper holds that the comprehensive administrative law enforcement system reform in our country,represented by the law enforcement power sinking to villages and towns,has made great achievements,but there are also many problems.This article through the Practice Present Situation Analysis,has summarized several typical questions,it includes the vague legal basis of the sinking of the law enforcement power,the unclear definition of the power and responsibility of the administrative law enforcement of the township government,the lack of law enforcement elements in the exercise of the administrative law enforcement power of the township government,the conflict between the sinking of the law enforcement power and the superior law,and the urgent need to perfect the supervision mechanism of the administrative law enforcement of the township government.This article straightens out the causes of the above-mentioned problems,to do a good job of paving the way for the next part of the suggestions and suggestions.The fifth part revolves around clarifying the legal basis of the power of administrative law enforcement,perfecting the power and responsibility mechanism of the power of administrative law enforcement,improving the efficiency of the power of administrative law enforcement,and establishing the negative list of the matters of administrative law enforcement,in the aspects of perfecting the supervision mechanism of the power of administrative law enforcement in villages and towns,this paper puts forward some countermeasures and suggestions for standardizing the power of administrative law enforcement in villages and towns,which mainly include amending the relevant provisions of the administrative permission law,the government should strictly enforce the administrative law to the township government,establish the coordination mechanism of power and responsibility,strengthen the financial guarantee and the construction of high-quality law enforcement personnel,and strengthen the supervision mechanism of the administrative law enforcement of the township government.
