| The scarcity of market resources is the focus of every country.In order to make the domestic market change from "big" to "strong" and give full play to the advantages of "super market",it is necessary to establish a "big" national unified big market.To implement the fair competition review system and strengthen the law enforcement of the fair competition review system is a key system to promote the construction of a national unified large market and an important guarantee to promote the construction of a pilot zone for the national new development pattern.First of all,in the introduction,this paper briefly introduces the emergence and development of the fair competition review system,and summarizes it from the perspective of factors affecting the implementation effect,and points out some problems in the practice.By defining the concept of the implementation of the fair competition review system,the research object is determined and summarized,so as to form a deeper understanding of the research object.Secondly,on the basis of relevant laws and policies,combined with the actual situation,analyzes the existing problems in the implementation of fair competition review in our country.Through the detailed analysis of the problems existing in the implementation of the review system of fair competition,it concludes that the review system of fair competition exists in the implementation process of review standards are not detailed enough,the defects of self-review is still obvious,regional blockade repeatedly and more than ban and imperfect judicial guarantee and supervision mechanism.Thirdly,it analyzes the legal and judicial status quo of the implementation and enforcement of the fair competition review system in the United States,the European Union,South Korea,Japan and other countries outside the region,and provides theoretical basis for improving the implementation system of the fair competition review system from the perspectives of improving the standards of the fair competition review,focusing on private interest relief,and improving the government subsidy fair competition review system.Finally,the question that our current fair competition system produces in the implementation process integrates,thus forms a systematized legal thinking.Put forward specific measures to refine the standards of fair competition review,make up for the defects of self-review,increase the intensity of review to break the regional blockade and improve the private relief and external supervision mechanism of fair competition review results. |
