| Free trade port is an important strategy for China to build a new pattern of all-round opening up based on the pilot free trade zone.As the core system to implement the basic position of competition policy,fair competition review system plays a crucial role in the construction of hainan free trade zone(port).However,a series of problems have been exposed in the practice of the system,which are mainly reflected in the lack of understanding of the competition policy of the policy-making organs in China,the lack of specific operation system of the local fair competition review,and the weak procedural guarantee and supervision mechanism of the fair competition review.The establishment of fair competition review system in free trade zone(Hong Kong)needs to be promoted from the aspects of shaping competition concept,constructing specific system and perfecting safeguard measures.In view of this,this paper discusses the fair competition examination system of free trade ports with Chinese characteristics.The paper is divided into three parts:The first part introduces the legitimacy of fair competition examination system under free trade port.Firstly,it is defined from the concept of fair competition and the concept of fair competition review system.Among them,fair competition is mainly defined from the question of whether the subjects of market competition have equality,while fair competition review system is mainly aimed at the policy making behavior of government departments to ensure the role of market in resource allocation.Second review system of China fair competition across regulatory impact assessment development stage,audit object mainly incremental policies and measures,the self-censorship,examining criterion of policymaking authorities four characteristics analysis with Chinese characteristics,combining with the fair competition of censorship to make up for the lack of anti-monopoly law regulation of administrative monopoly and administrative procedure and docking in international economic and trade rules,can enhance the development of Chinese economic and trade relations legal value of the space,put forward to build the Chinese characteristic value analysis of fair competition in the free trade port of censorship.The second part investigates the fair competition review system of external free trade ports,and analyzes and compares the internal assessment system led by Singapore regulatory agencies,the direct external review model of the eu and the fair competition review system of free trade ports of three countries and regions in Hong Kong.The fair competition review system for free trade ports of various countries andregions has rich experience in the values,subjects,scope,procedures and safeguard measures of the review system,and a fair competition review system for free trade ports with Chinese characteristics has been formed in light of the specific conditions in China.The third part consists of the third and fourth chapters of this paper.On the basis of the first two parts,it summarizes and analyzes the implementation status and problems of China’s fair competition review system,and then proposes the construction of fair competition review system for free trade ports with Chinese characteristics.In this paper,the third chapter from the system operation and system implementation of the results of the paper analyzes the current situation of fair competition of China,it is concluded that China fair competition there is censorship policy authority is not enough,institutions exist weakness,dry for a long time by the government,industry organizations,the public understanding of competition censorship does not reach the designated position four aspects of the problem.Chapter four puts forward Suggestions to improve China’s fair competition policy,aiming at establishing a fair competition review system for free trade ports with Chinese characteristics.In combination with the specific conditions of China’s free trade ports,the fair competition review system with Chinese characteristics for China’s free trade ports is constructed from the aspects of supervision mechanism within the system,social co-governance system,government competition review incentive system,information disclosure mechanism and talent team construction. |
