Research On The Disclosure Of Supervision Information

The supervisory information disclosure system aims to strengthen the supervision and restriction of supervisory power by enhancing the transparency of the supervisory committee,and ensure that supervisory power can operate on the correct track.However,the current legislative level of the Supervision Law only provides for the disclosure of supervisory information in a general manner,and does not provide detailed specifications for the principles,subjects,scope,procedures,and remedies for improper disclosure;At the practical level,due to the lack of legal norms,supervisory committees at all levels lack unified and clear execution standards in the work of disclosing supervisory information,resulting in frequent confusion in the disclosure of supervisory information.Therefore,it is imperative to conduct in-depth research on the disclosure system of supervisory information.The first part of this article first clarifies the current status and shortcomings of China’s supervisory information disclosure work,and points out that there are issues with unclear principles,subjects,and scope in China’s supervisory information disclosure system at the substantive level;At the procedural level,there are issues such as insufficient active disclosure procedures,lack of disclosure procedures based on application,and insufficient supervision and relief procedures.The second part discusses the issues mentioned in the first part and proposes feasible suggestions that are conducive to the construction of a Chinese characteristic supervisory information disclosure system.Propose that the principles,subjects,and scope of monitoring information disclosure should be clearly defined;Improve the proactive disclosure procedures for supervisory information,the disclosure procedures based on application,and explore new relief procedures when judicial relief procedures cannot be introduced.Strive to work together from both the substantive and procedural perspectives to establish a sound system for disclosing supervisory information.The final part summarizes that the construction of the supervisory information disclosure system has important theoretical guidance for the practice of supervisory information disclosure in China,and suggests that it should be promptly put on the legislative agenda...
