Since the reform of the supervisory system and the promulgation of the Supervision Law,supervisory commissions have become an important part of state institutions and shoulder important supervisory responsibilities.The power of supervision and investigation is the premise of effective supervision by the supervisory committee,the core power of the supervisory committee.Although the nature of the power of supervision and investigation is still controversial in the academic circle,its role in punishing duty crimes and purifying China's political ecology is still not to be underestimated.The power of supervision and investigation is a new kind of state power.Although it has the nature of investigation power and the characteristics of administrative investigation power,it also has its own distinctive characteristics.For example,The exercising subject has authority,It is political,coercive and comprehensive at birth.It has been three years since the introduction of the Supervision Law and the full operation of the supervisory commission's power of investigation.In the process of operation,some problems have gradually emerged,mainly in the following aspects.First is the problem of the investigation system,the monorail system of investigation is lack of a certain scientific nature.Second is the supervision problem in the exercise of the investigation power,the internal supervision organization lacks independence,the supervision force is scattered,and the power is lack of restriction.Third,there is a lack of guarantee in the exercise of the right of investigation,especially in the implementation of lien measures and the involvement of lawyers.In view of the above problems,we must improve the right of investigation from the transformation of the investigation system,the perfection of the internal and external supervision system,the protection and relief of the rights of the investigated.
