Study On Legal Guarantee Of The Development Of Collective Forest Health Industry

With the continuous promotion of China’s economic transformation and upgrading,the collective woodland forest health care industry,as a comprehensive industry integrating health care,medical treatment,tourism and pension,has been ushering in significant opportunities for development.On the one hand,influenced by the aggravation of population aging and the spread of subhealth conditions,the public’s demand for health care is growing day by day,and the development potential of forest health care market is constantly expanding;on the other hand,since the rural revitalization strategy was proposed in the report of the 19 th CPC National Congress,the central government has issued several documents,proposing to promote the deep integration of agriculture and health care industry.The development of forest health care industry has become an important measure to promote rural revitalization.The collective forest and forest health industry is not only an integral part of the big health industry,but also an effective way to connect the strategies of rural revitalization and ecological civilization.In order to promote the transformation and upgrading of rural industries and implement the health China strategy,the state has issued a large number of policy documents in recent years to encourage the development of forest health industry.The issue of forest health care has also gradually attracted the attention of scholars.However,most of the research on forest health care industry is concentrated in the fields of forestry and economics,,and fewer studies have been conducted on forest health care industry in collective forest land in the field of law.Although most of the previous studies recognized the promoting effect of forest health and maintenance on rural revitalization,they have not yet considered rural areas as the center of future forest health care industry development and failed to construct legal safeguard measures for the development of collective forest and forest health and maintenance industry systematically.Based on the legal theory and from the perspective of rural priority development,this study faces up to the practical problems and legal dilemmas encountered in the development of the collective forest and forest health industry,and seeks effective legal measures and institutional design to guarantee the healthy development of forest health industry in collective forest land.This study is mainly divided into the following six parts:First,with the background of China’s rural revitalization and health China strategies,we explore the significance of developing the forest health care industry in rural areas on a priority basis from both theoretical and practical perspectives;This paper reviews domestic and foreign literatures on the basic theory,current situation and obstacle factors of forest health care industry,analyzes the shortcomings of existing researches,and innovatively analyze the rule of law for the development of this industry field from the perspective of rural development on a priority basis.The study also analyzes the shortcomings of the existing studies and analyzes the rule of law for the development of this industry from the perspective of rural development.Secondly,by summarizing and analyzing relevant literature and current political data,interpreting the forest health care concepts proposed by different scholars and relevant laws and policy documents,we conclude that the forest health care industry in collective forest land has characteristics of uniqueness,universality,complementarity,and market flexibility,etc.;using human rights protection theory,social middle layer theory,and equitable development theory,we provide the analysis method and theoretical basis for the development of the collective forest land and forest health care industry.Thirdly,based on the actual situation of rural development,we discuss the necessity and realistic basis of developing the forest health care industry in collective forest land in rural areas as a priority.This paper explains the necessity of industrial development from the perspective of practicing the concept of rural priority development,exploring the diversified development of rural industries and meeting the market demand of big health industries.In the context of the implementation of the rural revitalization strategy and the change of national health concept,based on the rapid development of rural home industry and the existing good ecological basic conditions,facing the rights and interests of farmers,summed up the advantages of rural development of collective woodland forest health industry,to explore the practical basis of industrial development.Fourth,the typical overseas forest health care industry system and relevant legal safeguard measures are analyzed to provide referential development ideas and legislative experience for Chinese industries;take the western region of Hubei as an example to explain the current situation of China’s collective woodland forest health care industry development;sort out the relevant legal regulations and policy documents of the industry and analyze its existing problems.Fifth,from the perspective of law,reality,policy and other aspects of collective woodland forest health care industry development difficulties are summarized.In terms of law,there are conflicts between industrial development needs and legal restrictions on the use of collective woodland,centralized management and poor flow of forest rights,and development of collective woodland and protection of environmental legal interests in the process of collective forest rights transfer;in terms of policy,it faces the dilemma of lack of regional coordination mechanism,weak linkage between social capital and farmers’ income rights,and lack of implementation of financial support policies and relevant regulations;in terms of reality,there are industrial financing In reality,there are problems of narrow industrial financing channels,insufficient protection of rest rights to inhibit industrial market demand,insufficient connection between industry and medical security system,and insufficient implementation of social security rights and employment rights of vulnerable groups.Sixth,by studying the problem and drawing on the rule of law experience from outside the region,feasible suggestions are put forward for the development of collective woodland and forest health care industry.Firstly,to improve the collective forest rights system by establishing a legal system that appropriately expands the use of collective woodland and improving the collective forest rights transfer system;secondly,the industry development should be promoted by formulating the policies of reasonable planning of the health base between regions and issuing preferential policies to encourage the connection between social capital and farmers’ interests.In addition,we should establish an industrial system to promote the investment of charity capital and a medical insurance system covering forest health care,improve the preferential investment system of village collective capital and set up a special health care holiday system to promote industrial development.Finally,adopt to improve the collective woodland forest health care industry financial support measures,establish the collective woodland forest health care industry related support mechanism,improve the industrial supervision and supervision mechanism,to establish and improve the collective woodland forest health industry development guarantee measures.
