With the steady advancement of judicial reform in China,the selection of post judges has been basically completed,but the corresponding judicial personnel classification management is still in the initial stage of exploration.As a new judicial assistant in the classification of judicial personnel,judge assistant is an important support for judges to concentrate on handling cases under the pressure of a large number of judges and an indispensable part of the process of promoting the elite and professionalization of judges,and plays an extremely important role in this round of judicial reform.However,at present,there is still a lack of unified standards for the assessment of the target responsibility of the judge assistant,which leads to the stagnation of the reform of the judge assistant system in the process of judicial system reform.The objective responsibility assessment of the judge assistant is the only way to promote the reform of the judge assistant system.At present,the academic circles at home and abroad focus on the selection,task,positioning,dilemma and improvement of the judge assistant,and lack of assessment of the target responsibility of the judge assistant.Based on the theory of management by objectives,Pareto rule,Washington Law of cooperation and other theories,after understanding the current situation of target responsibility assessment of Wenzhou assistant judges,this paper finds that there are five problems in the assessment of target responsibility of Wenzhou assistant judges,such as unscientific assessment concept,imperfect mechanism,inadequate implementation,unreasonable rewards and punishments,and weak application of results.After further analysis,It is concluded that the reason lies in the unchanged assessment concept,the imperfect system,the lack of evaluation and feedback mechanism,the improvement of incentive measures and the ill-use of results.This paper takes the current situation of target responsibility assessment of judge assistants in Wenzhou as the starting point,draws on the advanced experience of American and German judge assistants’ target responsibility assessment,and combines the author’s own judicial practice of Wenzhou grassroots courts.From the five aspects of transforming the goal responsibility assessment concept of judge assistant,perfecting the goal responsibility assessment system,establishing an effective evaluation and feedback mechanism,setting up a scientific and reasonable incentive and punishment system,and strengthening the application mechanism of assessment results,this paper puts forward some countermeasures to optimize the goal responsibility assessment of judge assistant,in order to provide some help to continuously promote the reform of judge assistant system.
