Through the reform of the judicial personnel system,our country has implemented the classified management of judicial personnel such as courts and procuratorates,and has grouped a small number of outstanding legal personnel into the ranks of judges and prosecutors in order to build a standardized,professional and professional judicial team.Thus realizing the goal of justice and fairness.Among these reform measures,the post mechanism of judge assistant is particularly important.The reform of the post mechanism for judges’ assistants involves the vital interests of the internal personnel of courts and procuratorates and is the key to the success or failure of the reform of the judicial system.The implementation of the post mechanism for judges’ assistants has rapidly promoted the reform process of judges’ professionalism,helped judges to reduce their work pressure,and enabled judges to have more time and energy to improve their professional level and the quality and efficiency of trials.It is also helpful to clarify the division of labor and responsibilities between judges and judicial auxiliary personnel,so that all kinds of personnel have a clear division of labor and perform their respective duties.It has been confirmed that it is of great significance to carry out the post mechanism of judge assistant in our country.Through the research and comparison of the post mechanism of judge assistants in developed countries outside the country,the advanced experience of the post mechanism of judge assistants in developed countries such as the United States and Germany is especially used for reference.Especially in optimizing the allocation,responsibility orientation,social security and other aspects to extract useful experience to improve our country’s judge assistant post mechanism.Due to the defects of the existing mechanism,the judge assistant post mechanism has many problems,such as the wide source of the main body,the single post responsibility,the strong administrative color,the difficulty of the judge assistant entering the post judge sequence,etc.,which makes the implementation of the judge assistant post mechanism blocked everywhere in practice.Through observation and comparison,empirical analysis and other methods,this paper puts forward a framework to construct and perfect the mechanism of judges assistant posts in China from both macro and objective aspects.It is necessary to further improve the relevant legal norms,vigorously remove the administration,clarify the position and responsibilities of judge assistants,improve the treatment of judge assistants,enhance the career promotion space of judge assistants,determine a scientific evaluation mechanism,and put forward targeted opinions on supporting measures.In order to offer some suggestions for the further improvement and development of the post mechanism of judge assistant.
