| With the rapid development of face recognition technology and its applications,my country’s legal system for personal information protection has gradually exposed its shortcomings and deficiencies.Different from general personal information,face recognition information,as a product of face recognition technology,has the characteristics of high recognition,immutability,and high sensitivity,which makes the traditional personal information protection framework how to balance protection and protection in the era of digital economy.The issue of fair use is slightly stretched.The era of the digital economy has put forward higher requirements for the personal information governance system.We should not only pay attention to the protection of natural persons’ personal information rights and interests,but also cannot ignore the reasonable needs of sensitive personal information represented by face recognition information.Therefore,in the era of the digital economy,the research on the rational use of face recognition information in my country has both theoretical and practical value,and how to balance the conflict of interests between the protection and rational use of face recognition information scientifically and effectively is the key to this proposition.In addition to the introduction and conclusion,this paper is divided into five chapters to discuss and elaborate on the rational use of face recognition information in my country.Specifically,the author starts from a theoretical overview,and intends to sort out the relevant theoretical issues involved in the rational use of face recognition information,so as to lay a foundation for the subsequent analysis and resolution of the problems existing in the rational use of face recognition information in my country’s legislation and practice.theoretical basis.Secondly,by sorting out the legislative status and judicial practice of the rational use of face recognition information in my country,it is concluded and summarized that there are three cruxes in the rational use of face recognition information in my country: First,the specific circumstances of the reasonable use of face recognition information are not clear;The criteria for judging the rational use of face recognition information are imperfect;third,the implementation mechanism for the rational use of face recognition information is not perfect.Finally,take the problem as the orientation,absorb and learn from the mature personal information governance experience abroad,try to build and improve the rational use system of face recognition information with Chinese characteristics,and provide intellectual reference for the healthy development of the digital economy era. |
