After the revision of the Law on the Prevention of Juvenile Delinquency and the Law on the Protection of Minors in 2020,China’s special education system has set off a new wave of research,this revision not only clarifies that the system has the dual attributes of national education and juvenile justice,but also responds to the more controversial part,distinguishes the types of manifestations of bad behavior and serious bad behavior,and sets up a reasonable grading system for scientific education and correction of minors,while clarifying the family,The responsibility of schools and social organizations and other institutions for juvenile crime prevention education drives multiple participating entities to do their best to perform their duties,promotes the special education of juveniles who have committed crimes to a higher level,and helps juveniles who have committed crimes return to normal life from all aspects.The research on China’s special education system is in full swing,combined with the current stage of theoretical discussion and practice,it should be clearly understood that the dual nature of national education and juvenile justice is the basis for discussing the system,and the dual nature can achieve the ultimate goal of education,correction,and rescue of minors who commit serious bad behavior,and it is also the greatest value of the system.In general,further building an independent and unified legal system from point to point to point on the existing legislative system is the premise and action guide for proposing specific improvement measures.Having the procuratorial organs as the center for the coordination of judicial and administrative powers,and at the same time building a power coordination system of various departments,is the best solution to solve the unclear problem of the exercise of power by state organs and promote their standardized use of power.Improving the procedural and substantive rights involved in the implementation of the system from the perspective of justice and education can weave the tightest protection net for the rights and interests of juveniles who have committed crimes.At the same time,absorb the advanced experience of some countries outside the region in correcting minors with similar conditions,realize localized transformation,and then enrich the content of China’s system.The implementation of the special education system is not only related to the healthy growth of juveniles who have committed crimes,but also belongs to the content of social governance,combining the characteristics of law and education,starting from theory and practice,and updating the design scheme of the system from an overall perspective,which is the best measure to promote the further scientific development of the system.
