With the transformation of government functions and the reform of administrative management system into the deep water zone,improving the administrative efficiency through the performance assessment of civil servants to further deepen the reform has become the focus of the party and the government.In view of the short time of implementation,the legal system for performance appraisal of local government civil servants in China is not yet perfect,and problems such as standardization and insufficient stability have emerged in practice.Therefore,this paper takes the construction of China’s rule of law government and the reform of the administrative management system as the macro background,and based on the current national conditions,mainly discusses the following three questions: Why should the performance appraisal of local government civil servants in China be included in the legal track? What are the practical difficulties in the construction of the legal system and what are the deep-seated reasons? What are the corresponding ideas and specific countermeasures of the legal system construction?In addition to the introduction and conclusion,the article is mainly divided into three parts to respond to the above three questions.The first part includes chapters 1 and 2,which mainly expound on the theory and historical basis of the legalization of the performance appraisal of local government civil servants.The article uses the theory of power supervision to answer "why assessment";Answer "who will assess" with the theory of administrative self-control;Answer the question of "what to assess" with the theory of administrative efficiency;The theory of rule of law government is used to answer the question "why legalization".In addition,by examining the evolution of the performance appraisal system for officials in China,this paper summarizes the characteristics and experience of the development of the system.The second part is the evaluation of the current situation of the performance appraisal system for local government civil servants.Firstly,Elaborating on the basis of performance appraisal of local government civil servants at three levels: the Constitution and laws,the Party’s normative documents,and local normative documents.Secondly,based on the current situation of the system,there are practical difficulties in the construction of the inductive legal system,such as low legislative level,single assessment subject,irregular assessment procedures,non-fulfillment of results,and lack of relief methods.Finally,the constraints of legalization construction are explained from four aspects: legal,institutional,cultural,and technical.The third part is the idea and countermeasures of legalizing the performance appraisal of local government civil servants.At the level of legislative thinking,it not only clarifies the positioning of legislation from the two aspects of the legislative subject and legislative level but also puts forward a progressive legislative approach that is in line with the current legislative situation.In the concrete countermeasure level of the legal system construction,the article proposes to establish the principle of implementing assessment by the law to bridge the shortcomings of the principle of administration according to law,implement the normalization and diversification of assessment subjects to overcome the limitations of a single assessment subject,strengthen the disclosure of government assessment information to standardize the strict compliance of assessment procedures,ensure the effective implementation of assessment results to encourage civil servants to take responsibility and improve the rights relief system to protect the rights of civil servants.
